66 AN ACT
77 relating to a restriction on permits authorizing discharges of
88 sewage effluent into any water in the contributing or recharge zone
99 of the San Antonio or Barton Springs segment of the Edwards Aquifer.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
1212 by adding Section 26.0465 to read as follows:
1313 Sec. 26.0465. RESTRICTION ON PERMITS FOR DISCHARGES OF
1414 SEWAGE EFFLUENT INTO WATER IN CERTAIN ZONES OF EDWARDS AQUIFER. (a)
1515 The commission may not:
1616 (1) issue a new permit authorizing the discharge of
1717 sewage effluent into any water in the contributing or recharge zone
1818 of the San Antonio or Barton Springs segment of the Edwards Aquifer;
1919 or
2020 (2) amend a permit that was issued before September 1,
2121 2017, to authorize an increase in the amount of sewage effluent that
2222 may be discharged into any water in the contributing or recharge
2323 zone of the San Antonio or Barton Springs segment of the Edwards
2424 Aquifer.
2525 (b) This section does not affect the authority of the
2626 commission to issue a new permit authorizing one or more of the
2727 following discharges or to amend a permit to authorize an increase
2828 in one or more of the following discharges:
2929 (1) a discharge of storm water runoff from:
3030 (A) an industrial facility;
3131 (B) a municipal storm sewer system that is
3232 separate and distinct from the municipality's wastewater
3333 collection system; or
3434 (C) construction activity;
3535 (2) a discharge from:
3636 (A) firefighting activity;
3737 (B) the flushing of a fire hydrant;
3838 (C) a potable water source, including the
3939 flushing of drinking fountain water or a water line;
4040 (D) an air conditioner or compressor if the
4141 discharge consists of uncontaminated condensate;
4242 (E) lawn watering or similar irrigation work;
4343 (F) pavement wash-down without the use of
4444 detergents or other chemicals if a spill or leak of toxic or
4545 hazardous material has not occurred or all spilled or leaked
4646 material has been removed;
4747 (G) a routine external building wash-down that
4848 does not use detergents or other compounds;
4949 (H) a foundation or footing drain if the
5050 discharge is not contaminated with a solvent or other process
5151 material; or
5252 (I) the spray-down of a lumber or wood product
5353 storage yard if chemical additives are not used in the spray-down
5454 water and chemicals are not applied to the lumber or wood products
5555 during storage;
5656 (3) a discharge of uncontaminated groundwater or
5757 spring water; or
5858 (4) a discharge of storm water or groundwater seepage
5959 from mine dewatering activity at a construction, sand and gravel,
6060 industrial sand, or crushed stone mining facility.
6161 SECTION 2. This Act takes effect September 1, 2017.
