9 | 9 | | of the San Antonio or Barton Springs segment of the Edwards Aquifer. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
---|
12 | 12 | | by adding Section 26.0465 to read as follows: |
---|
13 | 13 | | Sec. 26.0465. RESTRICTION ON PERMITS FOR DISCHARGES OF |
---|
14 | 14 | | SEWAGE EFFLUENT INTO WATER IN CERTAIN ZONES OF EDWARDS AQUIFER. (a) |
---|
15 | 15 | | The commission may not: |
---|
16 | 16 | | (1) issue a new permit authorizing the discharge of |
---|
17 | 17 | | sewage effluent into any water in the contributing or recharge zone |
---|
18 | 18 | | of the San Antonio or Barton Springs segment of the Edwards Aquifer; |
---|
19 | 19 | | or |
---|
20 | 20 | | (2) amend a permit that was issued before September 1, |
---|
21 | 21 | | 2017, to authorize an increase in the amount of sewage effluent that |
---|
22 | 22 | | may be discharged into any water in the contributing or recharge |
---|
23 | 23 | | zone of the San Antonio or Barton Springs segment of the Edwards |
---|
24 | 24 | | Aquifer. |
---|
25 | 25 | | (b) This section does not affect the authority of the |
---|
26 | 26 | | commission to issue a new permit authorizing one or more of the |
---|
27 | 27 | | following discharges or to amend a permit to authorize an increase |
---|
28 | 28 | | in one or more of the following discharges: |
---|
29 | 29 | | (1) a discharge of storm water runoff from: |
---|
30 | 30 | | (A) an industrial facility; |
---|
31 | 31 | | (B) a municipal storm sewer system that is |
---|
32 | 32 | | separate and distinct from the municipality's wastewater |
---|
33 | 33 | | collection system; or |
---|
34 | 34 | | (C) construction activity; |
---|
35 | 35 | | (2) a discharge from: |
---|
36 | 36 | | (A) firefighting activity; |
---|
37 | 37 | | (B) the flushing of a fire hydrant; |
---|
38 | 38 | | (C) a potable water source, including the |
---|
39 | 39 | | flushing of drinking fountain water or a water line; |
---|
40 | 40 | | (D) an air conditioner or compressor if the |
---|
41 | 41 | | discharge consists of uncontaminated condensate; |
---|
42 | 42 | | (E) lawn watering or similar irrigation work; |
---|
43 | 43 | | (F) pavement wash-down without the use of |
---|
44 | 44 | | detergents or other chemicals if a spill or leak of toxic or |
---|
45 | 45 | | hazardous material has not occurred or all spilled or leaked |
---|
46 | 46 | | material has been removed; |
---|
47 | 47 | | (G) a routine external building wash-down that |
---|
48 | 48 | | does not use detergents or other compounds; |
---|
49 | 49 | | (H) a foundation or footing drain if the |
---|
50 | 50 | | discharge is not contaminated with a solvent or other process |
---|
51 | 51 | | material; or |
---|
52 | 52 | | (I) the spray-down of a lumber or wood product |
---|
53 | 53 | | storage yard if chemical additives are not used in the spray-down |
---|
54 | 54 | | water and chemicals are not applied to the lumber or wood products |
---|
55 | 55 | | during storage; |
---|
56 | 56 | | (3) a discharge of uncontaminated groundwater or |
---|
57 | 57 | | spring water; or |
---|
58 | 58 | | (4) a discharge of storm water or groundwater seepage |
---|
59 | 59 | | from mine dewatering activity at a construction, sand and gravel, |
---|
60 | 60 | | industrial sand, or crushed stone mining facility. |
---|
61 | 61 | | SECTION 2. This Act takes effect September 1, 2017. |
