99 relating to the establishment of a pilot program for the issuance of
1010 digital identification.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 7, Transportation Code, is
1313 amended by adding Chapter 526 to read as follows:
1414 CHAPTER 526. DIGITAL IDENTIFICATION PILOT PROGRAM
1515 Sec. 526.001. DEFINITIONS. In this chapter:
1616 (1) "Department" and "driver's license" have the
1717 meanings assigned by Section 521.001.
1818 (2) "Digital identification" includes digital
1919 driver's licenses and digital personal identification
2020 certificates.
2121 Sec. 526.002. DIGITAL IDENTIFICATION PILOT PROGRAM. (a)
2222 The department by rule shall establish a pilot program for the
2323 issuance of digital identification.
2424 (b) In establishing the digital identification pilot
2525 program, the department shall:
2626 (1) assess existing department infrastructure and
2727 identify changes required to implement the program;
2828 (2) upgrade department infrastructure according to
2929 the department's findings under Subdivision (1);
3030 (3) acquire a mobile application that:
3131 (A) displays digital identification that
3232 includes the information described by Section 521.121(a) on a
3333 wireless communication device;
3434 (B) includes an authentication and verification
3535 process for a wireless communication device; and
3636 (C) may be used in any location regardless of the
3737 location's level of wireless connectivity or cellular telephone
3838 service;
3939 (4) deploy the digital identification mobile
4040 application at no cost to focus groups for testing and evaluation;
4141 and
4242 (5) implement a law enforcement version of the
4343 application for field testing.
4444 (c) Digital identification issued under this section may
4545 not be used or accepted as valid proof of identification.
4646 (d) The department may contract with a third party to
4747 establish the pilot program described by this section if the
4848 contract is at no cost to the department.
4949 (e) The department shall prepare a report containing the
5050 results of the pilot program and the department's recommendations.
5151 The department shall submit the report to the Public Safety
5252 Commission and the legislature not later than the 180th day after
5353 the date of completion of the pilot program.
5454 Sec. 526.003. EXPIRATION. This chapter expires September
5555 1, 2019.
5656 SECTION 2. The Department of Public Safety shall adopt the
5757 initial rules for the digital identification pilot program under
5858 Chapter 526, Transportation Code, as added by this Act, not later
5959 than February 1, 2018.
6060 SECTION 3. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2017.
