| 6 | 6 | | relating to the issuance of school district teaching permits to |
|---|
| 7 | 7 | | authorize individuals to teach certain classes. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 21.055(d-1), Education Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (d-1) Subsections (b), (c), and (d) do not apply to a person |
|---|
| 12 | 12 | | who will teach only noncore academic career and technical education |
|---|
| 13 | 13 | | courses, applied STEM courses as defined by Education Code 28.027, |
|---|
| 14 | 14 | | or noncore mathematics courses. A school district board of |
|---|
| 15 | 15 | | trustees may issue a school district teaching permit to a person who |
|---|
| 16 | 16 | | will teach only those courses [only in career and technical |
|---|
| 17 | 17 | | education] based on qualifications certified by the superintendent |
|---|
| 18 | 18 | | of the school district. Qualifications must include demonstrated |
|---|
| 19 | 19 | | subject matter expertise such as professional work experience, |
|---|
| 20 | 20 | | formal training and education, holding an active professional |
|---|
| 21 | 21 | | relevant industry license, certification, or registration, or any |
|---|
| 22 | 22 | | combination of work experience, training and education, or industry |
|---|
| 23 | 23 | | license, certification, or registration, in the subject matter to |
|---|
| 24 | 24 | | be taught. The superintendent of the school district shall certify |
|---|
| 25 | 25 | | to the board of trustees that a new employee has undergone a |
|---|
| 26 | 26 | | criminal background check and is capable of proper classroom |
|---|
| 27 | 27 | | management. A school district shall require a new employee to |
|---|
| 28 | 28 | | obtain at least 20 hours of classroom management training and to |
|---|
| 29 | 29 | | comply with continuing education requirements as determined by the |
|---|
| 30 | 30 | | board of trustees. A person may teach a [career and technical |
|---|
| 31 | 31 | | education] course specified in this subsection |
|---|
| 32 | 32 | | immediately upon |
|---|
| 33 | 33 | | issuance of a permit under this subsection. Promptly after |
|---|
| 34 | 34 | | employing a person who qualifies under this subsection, the board |
|---|
| 35 | 35 | | of trustees shall send to the commissioner a written statement |
|---|
| 36 | 36 | | identifying the person, the course the person will teach, and the |
|---|
| 37 | 37 | | person's qualifications to teach the course. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2017. |
