85 AN ACT
96 relating to cardiac assessments of high school participants in
107 extracurricular athletic activities sponsored or sanctioned by the
118 University Interscholastic League.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1411 amended by adding Section 33.095 to read as follows:
1512 Sec. 33.095. CARDIAC ASSESSMENTS OF HIGH SCHOOL
1613 PARTICIPANTS IN EXTRACURRICULAR ATHLETIC ACTIVITIES. (a) A school
1714 district must require a district student who is required under
1815 University Interscholastic League rule or policy to receive a
1916 physical examination before being allowed to participate in an
2017 athletic activity sponsored or sanctioned by the University
2118 Interscholastic League to also have administered to the student an
22- electrocardiogram or echocardiogram before being allowed to
23- participate in the activity, including a practice for the activity,
24- as follows:
19+ electrocardiogram before being allowed to participate in the
20+ activity, including a practice for the activity, as follows:
2521 (1) one time before the student's first year of
2622 participation at the ninth grade level or above; and
27- (2) if 11th grade is not the student's first year of
28- participation, another time before the student's subsequent year of
29- participation at the 11th grade level.
23+ (2) another time before the student's third year of
24+ participation.
3025 (b) This section does not create a cause of action or
3126 liability against an appropriately licensed or certified health
3227 care professional, a school district, or a district officer or
3328 employee for the injury or death of a student participating in or
3429 practicing for an athletic activity sponsored or sanctioned by the
3530 University Interscholastic League based on or in connection with
3631 the administration or evaluation of or reliance on an
3732 electrocardiogram or on an echocardiogram.
38- (c) To facilitate the administration of electrocardiograms
39- or echocardiograms to students, a school district may:
40- (1) at the district's expense, partner with a
41- nonprofit entity to provide electrocardiograms or echocardiograms;
42- or
43- (2) elect to pay for the costs of administering
44- electrocardiograms or echocardiograms to students.
45- (d) The University Interscholastic League shall adopt rules

47- (e) The rules adopted under Subsection (d) must include:

57- SECTION 2. This Act applies beginning with the 2017-2018

5946 SECTION 3. This Act takes effect immediately if it receives
6047 a vote of two-thirds of all the members elected to each house, as
6148 provided by Section 39, Article III, Texas Constitution. If this
6249 Act does not receive the vote necessary for immediate effect, this
6350 Act takes effect September 1, 2017.
