44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the dispensing of certain drugs by therapeutic
77 optometrists.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter H, Chapter 351, Occupations Code, is
1010 amended by adding Section 351.368 to read as follows:
1111 Section 351.368. SALE AND DISPENSING OF MEDICATIONS. (a)
1212 In this section, "dangerous drug" has the meaning assigned by
1313 Section 483.001, Health and Safety Code.
1414 (b) A therapeutic optometrist licensed under this subtitle
1515 may supply a patient with any drug, remedy, or clinical supply that
1616 is within the scope of practice of a therapeutic optometrist
1717 necessary to meet the patient's immediate needs.
1818 (c) To the extent permitted by the scope of practice of a
1919 therapeutic optometrist, a therapeutic optometrist may dispense
2020 dangerous drugs to the therapeutic optometrist's patients and
2121 charge the patients for the drugs without complying with Chapter
2222 558.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2017.
