8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter H, Chapter 351, Occupations Code, is |
---|
10 | 10 | | amended by adding Section 351.368 to read as follows: |

11 | 11 | | Section 351.368. SALE AND DISPENSING OF MEDICATIONS. (a) |
---|
12 | 12 | | In this section, "dangerous drug" has the meaning assigned by |
---|
13 | 13 | | Section 483.001, Health and Safety Code. |
---|
14 | 14 | | (b) A therapeutic optometrist licensed under this subtitle |
---|
15 | 15 | | may supply a patient with any drug, remedy, or clinical supply that |
---|
16 | 16 | | is within the scope of practice of a therapeutic optometrist |
---|
17 | 17 | | necessary to meet the patient's immediate needs. |
---|
18 | 18 | | (c) To the extent permitted by the scope of practice of a |
---|
19 | 19 | | therapeutic optometrist, a therapeutic optometrist may dispense |
---|
20 | 20 | | dangerous drugs to the therapeutic optometrist's patients and |
---|
21 | 21 | | charge the patients for the drugs without complying with Chapter |
---|
22 | 22 | | 558. |
---|
23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
---|
24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
---|
25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
---|
27 | 27 | | Act takes effect September 1, 2017. |
