9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. The heading to Section 223.003, Transportation | |
11 | 11 | Code, is amended to read as follows: | |
12 | 12 | Sec. 223.003. NOTICE OF PROPOSED CONTRACTS [BY MAIL]. | |
13 | 13 | SECTION 2. Sections 223.003(a), (b), and (c), | |
14 | 14 | Transportation Code, are amended to read as follows: | |
15 | 15 | (a) A person may apply to have the name of the person placed | |
16 | 16 | on a [mailing] list to receive notice of any proposed contracts. | |
17 | 17 | (b) The department shall send [mail] the notice to each | |
18 | 18 | person on that [mailing] list. The department may send the notice | |
19 | 19 | by mail or electronically to an e-mail address designated by the | |
20 | 20 | person. | |
21 | 21 | (c) The department may require each applicant to pay an | |
22 | 22 | annual subscription fee set by the department in an amount not to | |
23 | 23 | exceed the average annual costs of sending [mailing] notices to the | |
24 | 24 | applicant. | |
25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2017. |
