55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to vehicles used in the maintenance of electrical power
88 lines; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.157(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) This section applies only to the following vehicles:
1313 (1) a stationary authorized emergency vehicle using
1414 visual signals that meet the requirements of Sections 547.305 and
1515 547.702;
1616 (2) a stationary tow truck using equipment authorized
1717 by Section 547.305(d); [and]
1818 (3) a Texas Department of Transportation vehicle not
1919 separated from the roadway by a traffic control channelizing device
2020 and using visual signals that comply with the standards and
2121 specifications adopted under Section 547.105; and
2222 (4) a vehicle used in the maintenance of an electrical
2323 power line and using visual signals that comply with the standards
2424 and specifications adopted under Section 547.105.
2525 SECTION 2. Sections 547.105(a) and (b), Transportation
2626 Code, are amended to read as follows:
2727 (a) The Texas Department of Transportation shall adopt
2828 standards and specifications that:
2929 (1) apply to lamps on highway maintenance and service
3030 equipment, including snow-removal equipment, and to vehicles used
3131 in the maintenance of electrical power lines; and
3232 (2) correlate with and conform as closely as possible
3333 to standards and specifications approved by the American
3434 Association of State Highway and Transportation Officials.
3535 (b) The Texas Department of Transportation may adopt
3636 standards and specifications for lighting that permit the use of
3737 flashing lights for identification purposes on highway maintenance
3838 and service equipment, including snow-removal equipment, and for
3939 vehicles used in the maintenance of electrical power lines.
4040 SECTION 3. The Texas Department of Transportation shall
4141 adopt standards and specifications relating to lamps and lighting
4242 on vehicles used in the maintenance of electrical power lines, as
4343 required by Section 547.105, Transportation Code, as amended by
4444 this Act, not later than October 1, 2017.
4545 SECTION 4. This Act takes effect September 1, 2017.
