| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. The heading to Section 387.0031, Local |
|---|
| 9 | 15 | | Government Code, is amended to read as follows: |
|---|
| 10 | 16 | | Sec. 387.0031. INCLUSION OF ROADS OR COUNTY PROPERTY IN |
|---|
| 11 | 17 | | CERTAIN DISTRICTS. |
|---|
| 12 | 18 | | SECTION 2. Section 387.0031, Local Government Code, is |
|---|
| 13 | 19 | | amended by amending Subsections (b) and (c) and adding Subsection |
|---|
| 14 | 20 | | (b-1) to read as follows: |
|---|
| 15 | 21 | | (b) The governing body of a district by order may include in |
|---|
| 16 | 22 | | the district a portion of a road or public right-of-way, including |
|---|
| 17 | 23 | | associated drainage areas, or county-owned property that is being |
|---|
| 18 | 24 | | used for a public purpose if: |
|---|
| 19 | 25 | | (1) the road, public right-of-way, or county-owned |
|---|
| 20 | 26 | | property [that] is located in a municipality located in the county |
|---|
| 21 | 27 | | that created the district; and |
|---|
| 22 | 28 | | (2) [if] the municipality consents to the inclusion. |
|---|
| 23 | 29 | | (b-1) An election is not required to approve an order |
|---|
| 24 | 30 | | described by Subsection (b) [this subsection]. |
|---|
| 25 | 31 | | (c) The district may use money available to the district to |
|---|
| 26 | 32 | | perform any function of the district under this chapter |
|---|
| 27 | 33 | | [maintenance or improvement] on a road or public right-of-way, |
|---|
| 28 | 34 | | including [and the] associated drainage areas, or any property |
|---|
| 29 | 35 | | included in the district in accordance with this section. |

| 30 | 36 | | SECTION 3. This Act takes effect September 1, 2017. |
