| 7 | 7 | | relating to the movement of equipment transporting intermodal |

| 8 | 8 | | shipping containers in international commerce. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 623.071, Transportation Code, is amended |
|---|
| 11 | 11 | | by amending Subsections (c) and (f) and adding Subsection (c-2) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (c) The department may issue an annual permit to allow the |
|---|
| 14 | 14 | | operation on a state highway of equipment that exceeds weight and |
|---|
| 15 | 15 | | size limits provided by law for the movement of: |
|---|
| 16 | 16 | | (1) an implement of husbandry by a dealer; |
|---|
| 17 | 17 | | (2) water well drilling machinery and equipment or |
|---|
| 18 | 18 | | harvesting equipment being moved as part of an agricultural |
|---|
| 19 | 19 | | operation; or |
|---|
| 20 | 20 | | (3) an intermodal shipping container moving in |
|---|
| 21 | 21 | | international commerce, subject to Subsection (c-2), or superheavy |
|---|
| 22 | 22 | | or oversize equipment that: |
|---|
| 23 | 23 | | (A) cannot reasonably be dismantled; and |
|---|
| 24 | 24 | | (B) does not exceed: |
|---|
| 25 | 25 | | (i) 12 feet in width; |
|---|
| 26 | 26 | | (ii) 14 feet in height; |
|---|
| 27 | 27 | | (iii) 110 feet in length; or |
|---|
| 28 | 28 | | (iv) 120,000 pounds gross weight. |
|---|
| 29 | 29 | | (c-2) The department may issue a permit under Subsection |
|---|
| 30 | 30 | | (c)(3) authorizing the movement of equipment transporting an |
|---|
| 31 | 31 | | intermodal shipping container if: |
|---|
| 32 | 32 | | (1) the issuance of the permit is not inconsistent |
|---|
| 33 | 33 | | with federal rules, regulations, or interpretations defining a |
|---|
| 34 | 34 | | nondivisible load; and |
|---|
| 35 | 35 | | (2) the equipment is operated only on a portion of a |
|---|
| 36 | 36 | | county road or state highway, including a frontage road adjacent to |
|---|
| 37 | 37 | | a federal interstate highway, that is within a 15-mile radius of a |
|---|
| 38 | 38 | | port authority. |
|---|
| 39 | 39 | | (f) In this section: |
|---|
| 40 | 40 | | (1) "Pipe [, "pipe] box" means a container |
|---|
| 41 | 41 | | specifically constructed to safely transport and handle oilfield |
|---|
| 42 | 42 | | drill pipe and drill collars. |
|---|
| 43 | 43 | | (2) "Port authority" means a port authority or |
|---|
| 44 | 44 | | navigation district created or operating under Section 52, Article |
|---|
| 45 | 45 | | III, or Section 59, Article XVI, Texas Constitution. |
|---|
| 46 | 46 | | SECTION 2. This Act takes effect September 1, 2017. |
