55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the movement of equipment transporting intermodal
88 shipping containers in international commerce.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 623.071, Transportation Code, is amended
1111 by amending Subsections (c) and (f) and adding Subsection (c-2) to
1212 read as follows:
1313 (c) The department may issue an annual permit to allow the
1414 operation on a state highway of equipment that exceeds weight and
1515 size limits provided by law for the movement of:
1616 (1) an implement of husbandry by a dealer;
1717 (2) water well drilling machinery and equipment or
1818 harvesting equipment being moved as part of an agricultural
1919 operation; or
2020 (3) an intermodal shipping container moving in
2121 international commerce, subject to Subsection (c-2), or superheavy
2222 or oversize equipment that:
2323 (A) cannot reasonably be dismantled; and
2424 (B) does not exceed:
2525 (i) 12 feet in width;
2626 (ii) 14 feet in height;
2727 (iii) 110 feet in length; or
2828 (iv) 120,000 pounds gross weight.
2929 (c-2) The department may issue a permit under Subsection
3030 (c)(3) authorizing the movement of equipment transporting an
3131 intermodal shipping container if:
3232 (1) the issuance of the permit is not inconsistent
3333 with federal rules, regulations, or interpretations defining a
3434 nondivisible load; and
3535 (2) the equipment is operated only on a portion of a
3636 county road or state highway, including a frontage road adjacent to
3737 a federal interstate highway, that is within a 15-mile radius of a
3838 port authority.
3939 (f) In this section:
4040 (1) "Pipe [, "pipe] box" means a container
4141 specifically constructed to safely transport and handle oilfield
4242 drill pipe and drill collars.
4343 (2) "Port authority" means a port authority or
4444 navigation district created or operating under Section 52, Article
4545 III, or Section 59, Article XVI, Texas Constitution.
4646 SECTION 2. This Act takes effect September 1, 2017.
