97 relating to the establishment of a junior college by certain
108 independent school districts.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 130.032, Education Code, is amended to
1311 read as follows:
1412 Sec. 130.032. RESTRICTIONS. (a) Except as provided by
1513 Subsection (b), in [In] order for any territorial unit set out in
1614 Sections 130.011 and 130.031 of this code to establish the
1715 applicable type of junior college, the proposed district must have
1816 a taxable property valuation of not less than $2.5 billion in the
1917 next preceding year and a total scholastic population of not less
2018 than 15,000 in the next preceding school year.
21- (b) An independent school district that is located in a
22- county with a population of less than 40,000 in which no junior
23- college campus is located and that is adjacent to a county with a
24- population of more than 3.3 million may establish a junior college
25- under Section 130.011 if the proposed junior college district has a
26- taxable property valuation greater than $5 billion in the next
27- preceding year and a total scholastic population greater than 5,000
28- in the next preceding year.
19+ (b) An independent school district in which no junior
20+ college campus is located may establish a junior college under
21+ Section 130.011 if the proposed district has a taxable property
22+ valuation greater than $5 billion in the next preceding year and a
23+ total scholastic population greater than 5,000 in the next
24+ preceding year.
2925 SECTION 2. This Act takes effect immediately if it receives
3026 a vote of two-thirds of all the members elected to each house, as
3127 provided by Section 39, Article III, Texas Constitution. If this
3228 Act does not receive the vote necessary for immediate effect, this
3329 Act takes effect September 1, 2017.
