1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter A, Chapter 822, Health and Safety
1412 Code, is amended by adding Section 822.008 to read as follows:
1513 Sec. 822.008. PETITION FOR MUNICIPAL ANIMAL CONTROL
16- AUTHORITY TO OPERATE IN EXTRATERRITORIAL JURISDICTION. (a) In
17- this section, "aggressive dog" means a dog that makes an unprovoked
18- attack on a domestic animal or livestock that:
19- (1) causes bodily injury to the animal or livestock;
20- and
21- (2) occurs in a place other than an enclosure:
22- (A) in which the dog was being kept; and
23- (B) that is reasonably secured to prevent the dog
24- from leaving the enclosure.
25- (b) A municipal animal control authority may impound and
26- manage dangerous dogs and aggressive dogs in the extraterritorial
27- jurisdiction of the municipality if:
14+ AUTHORITY TO OPERATE IN EXTRATERRITORIAL JURISDICTION. A municipal
15+ animal control authority may impound and manage dangerous animals,
16+ including dangerous dogs, in the extraterritorial jurisdiction of
17+ the municipality if:
2818 (1) the authority receives a petition signed by at
29- least three residents from three different households in the
30- extraterritorial jurisdiction requesting assistance from the
31- authority and alleging that:
32- (A) dangerous dogs or aggressive dogs have
33- repeatedly attacked humans, domestic animals, or livestock within
19+ least five residents of the extraterritorial jurisdiction
20+ requesting assistance from the authority and alleging that:
21+ (A) dangerous animals, including dogs or
22+ coyotes, have repeatedly attacked humans, pets, or livestock within
3423 the extraterritorial jurisdiction; and
35- (B) due to the presence of dangerous dogs or
36- aggressive dogs, the extraterritorial jurisdiction is an unsafe
37- environment for humans, domestic animals, or livestock; and
38- (2) in the extraterritorial jurisdiction:
39- (A) no animal control authority is authorized to
40- operate; or
41- (B) the operating animal control authority does
42- not provide for the impoundment or management of dangerous dogs or
43- aggressive dogs.
24+ (B) due to the presence of dangerous animals, the
25+ extraterritorial jurisdiction is an unsafe environment for humans,
26+ pets, or livestock; and
27+ (2) another animal control authority is not authorized
28+ to operate within the extraterritorial jurisdiction.
4429 SECTION 2. This Act takes effect immediately if it receives
4530 a vote of two-thirds of all the members elected to each house, as
4631 provided by Section 39, Article III, Texas Constitution. If this
4732 Act does not receive the vote necessary for immediate effect, this
4833 Act takes effect September 1, 2017.
