| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 201.6105 to read as follows: |
|---|
| 12 | 12 | | Sec. 201.6105. LIVE SOUND STUDY. Not later than one year |
|---|
| 13 | 13 | | after the department completes a transportation project that |
|---|
| 14 | 14 | | includes a sound barrier, the department shall conduct a live sound |
|---|
| 15 | 15 | | study to assess the implementation and effectiveness of the sound |
|---|
| 16 | 16 | | barrier. If the results of the study show that sound mitigation |
|---|
| 17 | 17 | | does not meet projected and modeled forecasts, the department shall |
|---|
| 18 | 18 | | modify the existing sound barrier or construct a new sound barrier |
|---|
| 19 | 19 | | to meet the forecasts. |

| 20 | 20 | | SECTION 2. Chapter 372, Transportation Code, is amended by |
|---|
| 21 | 21 | | adding Subchapter D to read as follows: |
|---|
| 22 | 22 | | SUBCHAPTER D. TOLL PROJECT CONSTRUCTION |
|---|
| 23 | 23 | | Sec. 372.151. LIVE SOUND STUDY. Not later than one year |
|---|
| 24 | 24 | | after a toll project entity completes a toll project that includes a |
|---|
| 25 | 25 | | sound barrier, the toll project entity shall conduct a live sound |
|---|
| 26 | 26 | | study to assess the implementation and effectiveness of the sound |
|---|
| 27 | 27 | | barrier. If the results of the study show that sound mitigation |
|---|
| 28 | 28 | | does not meet projected and modeled forecasts, the toll project |
|---|
| 29 | 29 | | entity shall modify the existing sound barrier or construct a new |
|---|
| 30 | 30 | | sound barrier to meet the forecasts. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2017. |
