| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | |
| 13 | 13 | is amended by adding Section 42.04413 to read as follows: | |
| 14 | 14 | Sec. 42.04413. PROHIBITION ON OBTAINING FIREARM | |
| 15 | 15 | INFORMATION. (a) This section applies to a person: | |
| 16 | 16 | (1) who holds a license, registration, or | |
| 17 | 17 | certification under this chapter; or | |
| 18 | 18 | (2) who applies for a license, registration, or | |
| 19 | 19 | certification under this chapter. | |
| 20 | 20 | (b) The department may not request, collect, compile, or | |
| 21 | 21 | disclose information regarding the lawful ownership, possession, | |
| 22 | 22 | use, or storage of a firearm or other weapon by a person described | |
| 23 | 23 | by Subsection (a). | |
| 24 | 24 | (c) A person who violates Subsection (b) commits an offense. | |
| 25 | 25 | An offense under this section is a Class C misdemeanor. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2017. |
