9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 12 | | SECTION 1. JOINT INTERIM COMMITTEE. (a) A joint interim |
---|
11 | 13 | | committee is created to study health benefit coverage for the |
---|
12 | 14 | | diagnosis and treatment of obesity provided by: |
---|
13 | 15 | | (1) group health benefit plans in the private market; |
---|
14 | 16 | | and |
---|
15 | 17 | | (2) plans and programs provided through government |
---|
16 | 18 | | entities. |
---|
17 | 19 | | (b) The committee shall be composed of: |
---|
18 | 20 | | (1) two senators appointed by the lieutenant governor; |
---|
19 | 21 | | (2) two representatives appointed by the speaker of |
---|
20 | 22 | | the house of representatives; and |
---|
21 | 23 | | (3) one member appointed by the governor, who shall |
---|
22 | 24 | | serve as the committee's presiding officer. |
---|
23 | 25 | | (c) The committee shall convene at the call of the presiding |
---|
24 | 26 | | officer. |
---|
25 | 27 | | (d) The committee has all other powers and duties provided |
---|
26 | 28 | | to a special or select committee by the rules of the senate and |
---|
27 | 29 | | house of representatives, by Subchapter B, Chapter 301, Government |
---|
28 | 30 | | Code, and by policies of the senate and house committees on |
---|
29 | 31 | | administration. |
---|
30 | 32 | | (e) From the contingent expense fund of the senate and the |
---|
31 | 33 | | contingent expense fund of the house of representatives equally, |
---|
32 | 34 | | the members of the committee are entitled to reimbursement for |
---|
33 | 35 | | expenses incurred in carrying out the provisions of this section in |
---|
34 | 36 | | accordance with the rules of the senate and house of |
---|
35 | 37 | | representatives and the policies of the senate and house committees |
---|
36 | 38 | | on administration. |
---|
37 | 39 | | (f) Not later than the 60th day after the effective date of |
---|
38 | 40 | | this Act, the lieutenant governor, the speaker of the house of |
---|
39 | 41 | | representatives, and the governor shall appoint the members of the |
---|
40 | 42 | | interim committee created under this section. |
---|
41 | 43 | | SECTION 2. STUDY. The committee created under Section 1 of |
---|
42 | 44 | | this Act shall, with respect to coverage for the diagnosis and |
---|
43 | 45 | | treatment of obesity provided by the plans and programs described |
---|
44 | 46 | | by Section 1(a) of this Act: |
---|
45 | 47 | | (1) study: |
---|
46 | 48 | | (A) health benefits that are currently provided |
---|
47 | 49 | | by those plans and programs; and |
---|
48 | 50 | | (B) exclusions from coverage under those plans |
---|
49 | 51 | | and programs; |
---|
50 | 52 | | (2) identify the extent to which health benefit |
---|
51 | 53 | | coverage provided is mandated or discretionary; |
---|
52 | 54 | | (3) identify diagnostic services and treatments for |
---|
53 | 55 | | which coverage is not offered by those plans and programs; |
---|
54 | 56 | | (4) determine the justifications for offering, |
---|
55 | 57 | | limiting, or excluding coverage and how decisions to offer, limit, |
---|
56 | 58 | | or exclude coverage are made; |
---|
57 | 59 | | (5) calculate and compare the direct and indirect |
---|
58 | 60 | | costs to an individual, the state, and the state economy associated |
---|
59 | 61 | | with: |
---|
60 | 62 | | (A) the provision of mandated coverage; |
---|
61 | 63 | | (B) the provision of other various levels of |
---|
62 | 64 | | coverage; and |
---|
63 | 65 | | (C) the exclusion of coverage; and |
---|
64 | 66 | | (6) identify the barriers that limit new or additional |
---|
65 | 67 | | coverage. |
---|
66 | 68 | | SECTION 3. FINDINGS AND RECOMMENDATIONS. Not later than |
---|
67 | 69 | | January 15, 2019, the committee created under Section 1 of this Act |
---|
68 | 70 | | shall report the committee's findings and recommendations to the |
---|
69 | 71 | | lieutenant governor, the speaker of the house of representatives, |
---|
70 | 72 | | and the governor. The committee shall include in its |
---|
71 | 73 | | recommendations specific statutory changes, including changes to |
---|
72 | 74 | | Subtitle E, Title 8, Insurance Code, that may appear necessary or |
---|
73 | 75 | | advisable from the committee's study under Section 2 of this Act. |
---|
74 | 76 | | SECTION 4. EXPIRATION. This Act expires September 1, 2019. |
---|
75 | 77 | | SECTION 5. EFFECTIVE DATE. This Act takes effect September |
---|
76 | 78 | | 1, 2017. |
