79 relating to a joint interim study regarding health benefit coverage
810 for obesity under certain health benefit plans.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. JOINT INTERIM COMMITTEE. (a) A joint interim
1113 committee is created to study health benefit coverage for the
1214 diagnosis and treatment of obesity provided by:
1315 (1) group health benefit plans in the private market;
1416 and
1517 (2) plans and programs provided through government
1618 entities.
1719 (b) The committee shall be composed of:
1820 (1) two senators appointed by the lieutenant governor;
1921 (2) two representatives appointed by the speaker of
2022 the house of representatives; and
2123 (3) one member appointed by the governor, who shall
2224 serve as the committee's presiding officer.
2325 (c) The committee shall convene at the call of the presiding
2426 officer.
2527 (d) The committee has all other powers and duties provided
2628 to a special or select committee by the rules of the senate and
2729 house of representatives, by Subchapter B, Chapter 301, Government
2830 Code, and by policies of the senate and house committees on
2931 administration.
3032 (e) From the contingent expense fund of the senate and the
3133 contingent expense fund of the house of representatives equally,
3234 the members of the committee are entitled to reimbursement for
3335 expenses incurred in carrying out the provisions of this section in
3436 accordance with the rules of the senate and house of
3537 representatives and the policies of the senate and house committees
3638 on administration.
3739 (f) Not later than the 60th day after the effective date of
3840 this Act, the lieutenant governor, the speaker of the house of
3941 representatives, and the governor shall appoint the members of the
4042 interim committee created under this section.
4143 SECTION 2. STUDY. The committee created under Section 1 of
4244 this Act shall, with respect to coverage for the diagnosis and
4345 treatment of obesity provided by the plans and programs described
4446 by Section 1(a) of this Act:
4547 (1) study:
4648 (A) health benefits that are currently provided
4749 by those plans and programs; and
4850 (B) exclusions from coverage under those plans
4951 and programs;
5052 (2) identify the extent to which health benefit
5153 coverage provided is mandated or discretionary;
5254 (3) identify diagnostic services and treatments for
5355 which coverage is not offered by those plans and programs;
5456 (4) determine the justifications for offering,
5557 limiting, or excluding coverage and how decisions to offer, limit,
5658 or exclude coverage are made;
5759 (5) calculate and compare the direct and indirect
5860 costs to an individual, the state, and the state economy associated
5961 with:
6062 (A) the provision of mandated coverage;
6163 (B) the provision of other various levels of
6264 coverage; and
6365 (C) the exclusion of coverage; and
6466 (6) identify the barriers that limit new or additional
6567 coverage.
6668 SECTION 3. FINDINGS AND RECOMMENDATIONS. Not later than
6769 January 15, 2019, the committee created under Section 1 of this Act
6870 shall report the committee's findings and recommendations to the
6971 lieutenant governor, the speaker of the house of representatives,
7072 and the governor. The committee shall include in its
7173 recommendations specific statutory changes, including changes to
7274 Subtitle E, Title 8, Insurance Code, that may appear necessary or
7375 advisable from the committee's study under Section 2 of this Act.
7476 SECTION 4. EXPIRATION. This Act expires September 1, 2019.
7577 SECTION 5. EFFECTIVE DATE. This Act takes effect September
7678 1, 2017.
