| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 21.057(e), Education Code, is amended to |
|---|
| 9 | 15 | | read as follows: |
|---|
| 10 | 16 | | (e) This section does not apply if a school is required in |
|---|
| 11 | 17 | | accordance with Section 1006 [1111(h)(6)(B)(ii)], Every Student |
|---|
| 12 | 18 | | Succeeds Act (20 U.S.C. Section 6312(e)(1)(B)(ii)) [No Child Left |
|---|
| 13 | 19 | | Behind Act of 2001 (20 U.S.C. Section 6311), and its subsequent |
|---|
| 14 | 20 | | amendments], to provide notice to a parent or guardian regarding a |
|---|
| 15 | 21 | | teacher who does not meet certification requirements at the grade |
|---|
| 16 | 22 | | level and subject area in which the teacher is assigned [is not |
|---|
| 17 | 23 | | highly qualified], provided the school provides notice as required |
|---|
| 18 | 24 | | by that Act. |
|---|
| 19 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 29 | | Act takes effect September 1, 2017. |
