55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a policy of a school district concerning possession of a
88 telecommunications device by a student.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.082, Education Code, is amended to
1111 read as follows:
1212 Sec. 37.082. POSSESSION OF TELECOMMUNICATIONS [PAGING]
1313 DEVICES. (a) The board of trustees of a school district may adopt a
1414 policy prohibiting a student from possessing a telecommunications
1515 [paging] device while on school property or while attending a
1616 school-sponsored or school-related activity on or off school
1717 property. The policy may establish disciplinary measures to be
1818 imposed for violation of the prohibition and may provide for
1919 confiscation of the telecommunications [paging] device.
2020 (b) A [The] policy adopted under Subsection (a) may provide
2121 for the district to[:
2222 [(1)] dispose of a confiscated telecommunications
2323 [paging] device in any reasonable manner after having provided the
2424 student's parent and any [the] company whose name and address or
2525 telephone number appear on the device 30 days' prior notice of the
2626 district's [its] intent to dispose of that device unless the device
2727 is reclaimed in accordance with this section before the end of the
2828 30-day period.
2929 (b-1) The notice under Subsection (b):
3030 (1) must [shall] include the serial number of the
3131 telecommunications device; and
3232 (2) may be made by telephone[, telegraph,] or in
3333 writing.
3434 (b-2) A school district may [; and (2)] charge the owner
3535 of the telecommunications device or the student's parent an
3636 administrative fee not to exceed $50 [$15] before the district [it]
3737 releases the device.
3838 (c) In this section, "telecommunications [paging] device"
3939 means a [telecommunications] device designed primarily for the
4040 purpose of making a phone call or of sending [that emits an audible
4141 signal, vibrates, displays] a message electronically. The term
4242 includes a smartphone.[, or otherwise summons or delivers a
4343 communication to the possessor. The term does not include an
4444 amateur radio under the control of an operator who holds an amateur
4545 radio station license issued by the Federal Communications
4646 Commission.]
4747 SECTION 2. This Act applies beginning with the 2017-2018
4848 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2017.
