126 AN ACT
13- relating to agriculture, including the regulation of seed by a
14- political subdivision and the abolition of certain entities
15- associated with the Department of Agriculture.

169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
17- SECTION 1. LOCAL REGULATION OF SEED. (a) Chapter 61,
18- Agriculture Code, is amended by adding Section 61.019 to read as
19- follows:
20- Sec. 61.019. LOCAL REGULATION OF SEED PROHIBITED. (a)
21- Notwithstanding any other law and except as provided by Subsection
22- (c), a political subdivision may not adopt an order, ordinance, or
23- other measure that regulates agricultural seed, vegetable seed,
24- weed seed, or any other seed in any manner, including planting seed
25- or cultivating plants grown from seed.
26- (b) An order, ordinance, or other measure adopted by a
27- political subdivision that violates Subsection (a) is void.
28- (c) A political subdivision may take any action otherwise
29- prohibited by this section to:
30- (1) comply with any federal or state requirements;
31- (2) avoid a federal or state penalty or fine;
32- (3) attain or maintain compliance with federal or
33- state environmental standards, including state water quality
34- standards; or
35- (4) implement a:
36- (A) water conservation plan;
37- (B) drought contingency plan; or
38- (C) voluntary program as part of a conservation
39- water management strategy included in the applicable regional water
40- plan or state water plan.
41- (d) Nothing in this section preempts or otherwise limits the
42- authority of any county or municipality to adopt and enforce zoning
43- regulations, fire codes, building codes, storm water regulations,
44- nuisance regulations as authorized by Section 342.004, Health and
45- Safety Code, or waste disposal restrictions.
46- (b) Section 61.019(b), Agriculture Code, as added by this
47- section, applies to an order, ordinance, or other measure adopted
48- before, on, or after the effective date of this Act.
49- SECTION 2. AGRICULTURE POLICY BOARD. (a) The Agriculture
