9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 1951.212, Occupations Code, is amended | |
11 | 11 | by adding Subsection (c-1) to read as follows: | |
12 | 12 | (c-1) Notwithstanding Section 1951.051(c) or this section, | |
13 | 13 | a school district employee is not required to hold a license under | |
14 | 14 | this chapter or Chapter 76, Agriculture Code, to apply at a school | |
15 | 15 | building or other school district facility, in a manner consistent | |
16 | 16 | with the label, a pesticide that is available for purchase by | |
17 | 17 | unlicensed members of the public. | |
18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
22 | 22 | Act takes effect September 1, 2017. |
