55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reducing regulations on the application of certain
88 pesticides by school district employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1951.212, Occupations Code, is amended
1111 by adding Subsection (c-1) to read as follows:
1212 (c-1) Notwithstanding Section 1951.051(c) or this section,
1313 a school district employee is not required to hold a license under
1414 this chapter or Chapter 76, Agriculture Code, to apply at a school
1515 building or other school district facility, in a manner consistent
1616 with the label, a pesticide that is available for purchase by
1717 unlicensed members of the public.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2017.
