66 AN ACT
77 relating to the contract management guide for state agencies.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2262.005, Government Code, is amended to
1010 read as follows:
1111 Sec. 2262.005. CONSULTATION WITH INTERESTED PARTIES [STATE
1212 AGENCIES]. The comptroller shall consult with state agencies,
1313 vendors, and other interested parties in developing rules, forms,
1414 contract terms, guides, manuals, and criteria required under this
1515 chapter.
1616 SECTION 2. Section 2262.051, Government Code, is amended by
1717 amending Subsections (a), (b), (c), (d), and (g) and adding
1818 Subsections (i) and (j) to read as follows:
1919 (a) In consultation with the attorney general, the
2020 Department of Information Resources, the [comptroller, and the]
2121 state auditor, and state agencies that award major contracts, the
2222 comptroller [commission] shall develop and [or] periodically
2323 update a contract management guide for use by state
2424 agencies. Participation by the state auditor under this
2525 subsection is subject to approval by the legislative audit
2626 committee for inclusion in the audit plan under Section 321.013(c).
2727 (b) The comptroller [commission] may adopt rules necessary
2828 to develop or update the guide.
2929 (c) The guide must provide information regarding the
3030 primary duties of a contract manager, including how to:
3131 (1) develop and negotiate a contract;
3232 (2) select a contractor; [and]
3333 (3) monitor contractor and subcontractor performance
3434 under a contract; and
3535 (4) encourage competition for goods and services
3636 purchased by this state.
3737 (d) The guide must include model provisions for state agency
3838 contracts. The guide must:
3939 (1) distinguish between essential provisions that a
4040 state agency must include in a contract to protect the interests of
4141 this state and recommended provisions that a state agency may
4242 include in a contract;
4343 (2) recognize the unique contracting needs of an
4444 individual state agency or program based on the size, nature, and
4545 type of goods or services purchased by the state agency or program
4646 and provide sufficient flexibility to accommodate those needs,
4747 consistent with protecting the interests of this state;
4848 (3) include maximum contract periods under which a new
4949 competitive solicitation is not necessary; and
5050 (4) include the model contract management process
5151 developed under Section 2262.104 and recommendations on the
5252 appropriate use of the model.
5353 (g) The guide must establish procedures under which a state
5454 agency is required to:
5555 (1) analyze the reasons [solicit explanations from
5656 qualified potential respondents who did not respond to] a
5757 competitive solicitation for a contract received fewer than two
5858 qualified bids; and
5959 (2) develop and implement improved procurement
6060 practices, including:
6161 (A) providing earlier notice to prospective
6262 vendors of the state agency's intent to issue a competitive
6363 solicitation;
6464 (B) expanding the time in which a prospective
6565 vendor may respond to a competitive solicitation;
6666 (C) improving up-front communication between a
6767 state agency and a prospective vendor about the state agency's
6868 needs and objectives; and
6969 (D) improving educational efforts by the state
7070 agency to understand vendor capabilities, skills, and benefits [on
7171 which fewer than two qualified bids were received by the agency].
7272 (i) The guide must suggest best practices related to
7373 procurement metrics used by a state agency to measure and monitor
7474 the effectiveness of the state agency's procurement methods,
7575 including the:
7676 (1) number and value of procurements made by the state
7777 agency;
7878 (2) number of canceled procurements by the state
7979 agency;
8080 (3) reasons for canceled procurements;
8181 (4) common exceptions to the state agency's terms and
8282 conditions by a respondent;
8383 (5) number of responses per competitive solicitation;
8484 and
8585 (6) average length of time for each phase of the state
8686 agency's procurement processes, including the length of time:
8787 (A) between the date the state agency issues the
8888 competitive solicitation and the date the state agency begins
8989 receiving responses to the solicitation;
9090 (B) for the evaluation of responses to a
9191 competitive solicitation;
9292 (C) of the negotiation between the state agency
9393 and a vendor; and
9494 (D) between the date the state agency issues the
9595 competitive solicitation and the date the state agency awards a
9696 contract to a vendor.
9797 (j) The guide may include references to procurement
9898 maturity models and procurement readiness assessments used by other
9999 large public and private enterprises.
100100 SECTION 3. This Act takes effect September 1, 2017.
