77 relating to authority of certain general-law municipalities to

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 43.032, Local Government
1111 Code, is amended to read as follows:
1212 Sec. 43.032. AUTHORITY OF CERTAIN [TYPE A] GENERAL-LAW
1313 MUNICIPALITIES TO ANNEX AN AREA ON [UPON] PETITION BY OWNERS.
1414 SECTION 2. Section 43.032(a), Local Government Code, is
1515 amended to read as follows:
1616 (a) The governing body of a general-law municipality with a
1717 population of 1,500 to 5,000 [1,599] may annex an area:
1818 (1) that is adjacent to the annexing municipality;
1919 (2) that is not being served with water or sewer
2020 service from a governmental entity; and
2121 (3) for which a petition requesting annexation has
2222 been filed with the municipality.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2017.
