95 AN ACT
10- relating to a report regarding certain health and safety
11- information prepared by the Texas Education Agency.
6+ relating to the School Health Survey.
127 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Section 38.0141, Education Code, is amended to
14- read as follows:
15- Sec. 38.0141. REPORTING OF CERTAIN HEALTH AND SAFETY
16- INFORMATION REQUIRED. (a) Each school district shall provide to
17- the agency information as required by the commissioner, including
18- statistics and data, relating to student health and physical
19- activity and information described by Section 28.004(k), presented
20- in a form determined by the commissioner. The district shall
21- provide the information required by this subsection [section] for
22- the district and for each campus in the district.
23- (b) Not later than one year after the agency receives the
24- information required by Subsection (a), the commissioner shall
25- complete a report on physical education provided by each school
26- district and publish the report on the agency's Internet website.
27- (c) The report must include:
8+ SECTION 1. Subchapter A, Chapter 38, Education Code, is
9+ amended by adding Section 38.0141(1) to read as follows:
10+ Sec. 38.0141(1) PHYSICAL EDUCATION ASSESSMENT. (a)
11+ The Commissioner shall ensure that the data for each school
12+ district is published on the Agency's website within one year of the
13+ data being collected (b) The data shall include the following:
2814 (1) The number of physical education classes offered
29- at each campus in the district and detail the number of days,
30- classes, and minutes offered each week by each campus;
15+ at each school and detail the number of days, classes, and minutes
16+ offered each week;
3117 (2) The ratio of students enrolled in physical
32- education classes in the district compared to the overall
18+ education classes compared to the overall
3319 enrollment;
3420 (3) The average physical education class size at each
35- campus in the district;
36- (4) the number of physical education teachers in the
37- district who are licensed, certified, or endorsed by an accredited
38- teacher preparation program to teach physical education;
39- (5) whether each campus in the district has the
40- appropriate equipment and adequate facilities for students to
41- engage in the amount and intensity of physical activity required
42- under Section 28.002;
43- (6) whether the district allows modifications or
44- accommodations that allow physical education courses to meet the
45- needs of students with disabilities; and
46- (7) whether the district has a policy that allows
47- teachers or administrators in the district to withhold physical
48- activity from a student as punishment.

29+ courses are allowed to meet the needs of students with
30+ disabilities;
31+ (7) Whether students may opt out of physical education
32+ to prepare for other classes or standardized tests;
33+ (8) Whether physical activity can be withheld as
34+ punishment;
4935 SECTION 2. This Act takes effect immediately if it receives
5036 a vote of two-thirds of all the members elected to each house, as
5137 provided by Section 39, Article III, Texas Constitution. If this
5238 Act does not receive the vote necessary for immediate effect, this
5339 Act takes effect September 1, 2017.
