55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administrative and civil consequences imposed by
88 the Department of Public Safety.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.042, Transportation Code, is amended
1111 by adding Subsections (f) and (g) to read as follows:
1212 (f) Except as provided by Subsection (g), the department may
1313 not consider a record of a conviction of a license holder that is
1414 received by the department after the first anniversary of the date
1515 of the conviction in a decision to impose an enforcement action
1616 against the license holder, including a decision to:
1717 (1) suspend, revoke, or deny renewal of the license
1818 holder's driver's license; or
1919 (2) assign points to the license holder's driver's
2020 license under Section 708.052.
2121 (g) The department may consider a record of a conviction of
2222 a license holder that is received by the department after the first
2323 anniversary of the date of the conviction in a decision to impose an
2424 enforcement action against the license holder if:
2525 (1) the license holder:
2626 (A) is a commercial driver's license holder or
2727 was a commercial driver's license holder at the time of the offense;
2828 (B) was operating a commercial motor vehicle at
2929 the time of the offense; or
3030 (C) was operating a motor vehicle and
3131 transporting a hazardous material at the time of the offense; or
3232 (2) the conviction is for an offense under Chapter 49,
3333 Penal Code.
3434 SECTION 2. Section 524.051(a), Transportation Code, is
3535 amended to read as follows:
3636 (a) After a [A] driver's license suspension [suspended]
3737 under this chapter has ended, the license may not be reinstated or
3838 another driver's license issued to the person until the person pays
3939 the department a fee of $125 in addition to any other fee required
4040 by law.
4141 SECTION 3. Section 724.046(a), Transportation Code, is
4242 amended to read as follows:
4343 (a) After a [A] license suspension [suspended] under this
4444 chapter has ended, the license may not be reinstated or a new
4545 license issued until the person whose license has been suspended
4646 pays to the department a fee of $125 in addition to any other fee
4747 required by law. A person subject to a denial order issued under
4848 this chapter may not, after the period of denial has ended, obtain a
4949 license [after the period of denial has ended] until the person pays
5050 to the department a fee of $125 in addition to any other fee
5151 required by law.
5252 SECTION 4. This Act takes effect September 1, 2017.
