410 AN ACT
511 relating to the timing of the expiration of water quality permits.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 26.0135(d), Water Code, is amended to
814 read as follows:
915 (d) As required [In the appropriate year of the cycle
1016 provided] by commission rules [adopted to implement Section
1117 26.0285], each river authority shall submit a written summary
1218 report to the commission, State Soil and Water Conservation Board,
1319 and Parks and Wildlife Department on the water quality assessment
1420 of the authority's watershed. The summary report must identify
1521 concerns relating to the watershed or bodies of water, including an
1622 identification of bodies of water with impaired or potentially
1723 impaired uses, the cause and possible source of use impairment, and
1824 recommended actions the commission may take to address those
1925 concerns. The summary report must discuss the public benefits from
2026 the water quality monitoring and assessment program, including
2127 efforts to increase public input in activities related to water
2228 quality and the effectiveness of targeted monitoring in assisting
2329 the permitting process. A river authority shall submit a summary
2430 report after the report has been approved by the basin steering
2531 committee and coordinated with the public and the commission. A
2632 river authority shall hold basin steering committee meetings and
2733 shall invite users of water and wastewater permit holders in the
2834 watershed who pay fees under Section 26.0291 to review the draft of
2935 the work plans and summary report. A river authority shall inform
3036 those parties of the availability and location of the summary
3137 report for inspection and shall solicit input from those parties
3238 concerning their satisfaction with or suggestions for modification
3339 of the summary report for the watershed, the operation or
3440 effectiveness of the watershed monitoring and assessment program
3541 authorized by this section, and the adequacy, use, or equitable
3642 apportionment of the program's costs and funds. A river authority
3743 shall summarize all comments received from persons who pay fees
3844 under Section 26.0291 and from steering committee members and shall
3945 submit the report and the summaries to the governor, the lieutenant
4046 governor, and the speaker of the house of representatives not later
4147 than the 90th day after the date the river authority submits the
4248 summary report to the commission and other agencies.
4349 SECTION 2. Section 26.0285, Water Code, is repealed.
4450 SECTION 3. This Act takes effect September 1, 2017.
