66 AN ACT
77 relating to the appointment of the commissioner of agriculture.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 11.004, Agriculture Code, is amended to
1010 read as follows:
1111 Sec. 11.004. APPOINTMENT [ELECTION] AND TERM OF
1212 COMMISSIONER. (a) The governor shall appoint the commissioner
1313 with the advice and consent of the senate [is elected for a term of
1414 four years].
1515 (b) The commissioner's term of office runs concurrently
1616 with the governor's.
1717 (c) The governor shall appoint another person as
1818 commissioner, with the advice and consent of the senate, to fill a
1919 vacancy in the office of commissioner.
2020 (d) The governor shall appoint the commissioner without
2121 regard to the race, color, disability, sex, religion, age, or
2222 national origin of the appointee.
2323 SECTION 2. Section 11.005(a), Agriculture Code, is amended
2424 to read as follows:
2525 (a) To be eligible for appointment [election] as
2626 commissioner [or appointment to fill a vacancy in the office of
2727 commissioner], a person must satisfy the requirements for holding
2828 elective office under Section 141.001, Election Code, and must:
2929 (1) have been engaged, for at least five of the 10
3030 years preceding the year in which the person is [elected or]
3131 appointed to the person's initial term, in the business of
3232 agriculture;
3333 (2) have worked, for the five-year period preceding
3434 the calendar year in which the person is [elected or] appointed to
3535 the person's initial term, for a state or federal agency in a
3636 position directly related to agriculture;
3737 (3) have owned or operated, for at least five of the 10
3838 years preceding the year in which the person is [elected or]
3939 appointed to the person's initial term, farm, ranch, or timber land
4040 that qualifies for agricultural use appraisal under Subchapter C,
4141 Chapter 23, Tax Code, and be participating, in the calendar year in
4242 which the person is [elected or] appointed to the person's initial
4343 term, in a farm program administered by the federal Farm Service
4444 Agency [Agricultural Stabilization and Conservation Service]; or
4545 (4) have worked, for at least five years at any time
4646 before the calendar year in which the person is [elected or]
4747 appointed to the person's initial term, for the Texas Agriculture
4848 [Agricultural] Council, an organization that is a member of the
4949 Texas Agriculture [Agricultural] Council, or another agricultural
5050 producer association.
5151 SECTION 3. Section 58.025, Agriculture Code, is amended to
5252 read as follows:
5353 Sec. 58.025. PUBLIC HEARINGS. The administrator, the
5454 commissioner, or an individual designated by the commissioner may
5555 conduct public hearings relating to issuance of the authority's
5656 bonds or the implementation of financial assistance, and the
5757 governor [commissioner] may act as the applicable elected
5858 representative for purposes of approving any bonds or financial
5959 assistance required to be approved, including any approval required
6060 under Section 147(f), [of the] Internal Revenue Code of 1986.
6161 SECTION 4. Section 52.092(c), Election Code, is amended to
6262 read as follows:
6363 (c) Statewide offices of the state government shall be
6464 listed in the following order:
6565 (1) governor;
6666 (2) lieutenant governor;
6767 (3) attorney general;
6868 (4) comptroller of public accounts;
6969 (5) commissioner of the General Land Office;
7070 (6) [commissioner of agriculture;
7171 [(7)] railroad commissioner;
7272 (7) [(8)] chief justice, supreme court;
7373 (8) [(9)] justice, supreme court;
7474 (9) [(10)] presiding judge, court of criminal
7575 appeals;
7676 (10) [(11)] judge, court of criminal appeals.
7777 SECTION 5. (a) The term of office of the commissioner of
7878 agriculture expires on the effective date of this Act.
7979 (b) As soon as practicable on or after the effective date of
8080 this Act, the governor shall appoint a person to the office of
8181 commissioner of agriculture in the manner provided by Section
8282 11.004, Agriculture Code, as amended by this Act.
8383 SECTION 6. This Act takes effect September 1, 2017.
