| 7 | 7 | | relating to eligibility for supplemental financial assistance |

| 8 | 8 | | provided to certain grandparents. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 31.0041, Human Resources Code, is |
|---|
| 11 | 11 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) To the extent funds are appropriated for this purpose, |
|---|
| 14 | 14 | | the commission may provide supplemental financial assistance in |
|---|
| 15 | 15 | | addition to the amount of financial assistance granted for the |
|---|
| 16 | 16 | | support of a dependent child under Section 31.003 to a person who: |
|---|
| 17 | 17 | | (1) is 45 years of age or older; |
|---|
| 18 | 18 | | (2) is the grandparent of the dependent child, as |
|---|
| 19 | 19 | | defined by Section 31.002, who lives at the person's residence; |
|---|
| 20 | 20 | | (3) is the primary caretaker of the dependent child; |
|---|
| 21 | 21 | | (4) has a family income that is at or below 200 percent |
|---|
| 22 | 22 | | of the federal poverty level; and |
|---|
| 23 | 23 | | (5) subject to Subsection (a-1), does not have |
|---|
| 24 | 24 | | resources that exceed the amount allowed for financial assistance |
|---|
| 25 | 25 | | under this chapter. |
|---|
| 26 | 26 | | (a-1) Notwithstanding Section 31.032(d)(2), in determining |
|---|
| 27 | 27 | | whether a person is eligible for supplemental financial assistance |
|---|
| 28 | 28 | | under this section, the commission shall exclude from the person's |
|---|
| 29 | 29 | | available resources the fair market value of the ownership interest |
|---|
| 30 | 30 | | of the applicant or a member of the applicant's household in a motor |
|---|
| 31 | 31 | | vehicle. |
|---|
| 32 | 32 | | SECTION 2. Section 31.0041, Human Resources Code, as |
|---|
| 33 | 33 | | amended by this Act, applies only to a determination of eligibility |
|---|
| 34 | 34 | | of a person for supplemental financial assistance under that |
|---|
| 35 | 35 | | section that is made on or after the effective date of this Act. |
|---|
| 36 | 36 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 37 | 37 | | a state agency determines that a waiver or authorization from a |
|---|
| 38 | 38 | | federal agency is necessary for implementation of that provision, |
|---|
| 39 | 39 | | the agency affected by the provision shall request the waiver or |
|---|
| 40 | 40 | | authorization and may delay implementing that provision until the |
|---|
| 41 | 41 | | waiver or authorization is granted. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2017. |
