66 AN ACT
77 relating to eligibility for supplemental financial assistance
88 provided to certain grandparents.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.0041, Human Resources Code, is
1111 amended by amending Subsection (a) and adding Subsection (a-1) to
1212 read as follows:
1313 (a) To the extent funds are appropriated for this purpose,
1414 the commission may provide supplemental financial assistance in
1515 addition to the amount of financial assistance granted for the
1616 support of a dependent child under Section 31.003 to a person who:
1717 (1) is 45 years of age or older;
1818 (2) is the grandparent of the dependent child, as
1919 defined by Section 31.002, who lives at the person's residence;
2020 (3) is the primary caretaker of the dependent child;
2121 (4) has a family income that is at or below 200 percent
2222 of the federal poverty level; and
2323 (5) subject to Subsection (a-1), does not have
2424 resources that exceed the amount allowed for financial assistance
2525 under this chapter.
2626 (a-1) Notwithstanding Section 31.032(d)(2), in determining
2727 whether a person is eligible for supplemental financial assistance
2828 under this section, the commission shall exclude from the person's
2929 available resources the fair market value of the ownership interest
3030 of the applicant or a member of the applicant's household in a motor
3131 vehicle.
3232 SECTION 2. Section 31.0041, Human Resources Code, as
3333 amended by this Act, applies only to a determination of eligibility
3434 of a person for supplemental financial assistance under that
3535 section that is made on or after the effective date of this Act.
3636 SECTION 3. If before implementing any provision of this Act
3737 a state agency determines that a waiver or authorization from a
3838 federal agency is necessary for implementation of that provision,
3939 the agency affected by the provision shall request the waiver or
4040 authorization and may delay implementing that provision until the
4141 waiver or authorization is granted.
4242 SECTION 4. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2017.
