| 7 | 13 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 14 | SECTION 1. Section 547.001, Transportation Code, is amended | |
| 9 | 15 | by adding Subdivision (5-a) to read as follows: | |
| 10 | 16 | (5-a) "Road machinery" means a self-propelled vehicle | |
| 11 | 17 | that: | |
| 12 | 18 | (A) was originally and permanently designed as | |
| 13 | 19 | machinery; | |
| 14 | 20 | (B) is not designed or used primarily to | |
| 15 | 21 | transport persons or property; and | |
| 16 | 22 | (C) is only incidentally operated on a highway. | |
| 17 | 23 | SECTION 2. This Act takes effect September 1, 2017. | |
