79 relating to grants awarded to reimburse counties for the cost of
810 monitoring defendants and victims in criminal cases involving
911 family violence.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Chapter 772, Government Code, is amended by
1214 adding Section 772.0073 to read as follows:
1315 Sec. 772.0073. GRANT PROGRAM FOR MONITORING DEFENDANTS AND
1416 VICTIMS IN FAMILY VIOLENCE CASES. (a) In this section:
1517 (1) "Criminal justice division" means the criminal
1618 justice division established under Section 772.006.
1719 (2) "Family violence" has the meaning assigned by
1820 Section 71.004, Family Code.
1921 (b) The criminal justice division shall establish and
2022 administer a grant program to reimburse counties for all or part of
2123 the costs incurred by counties as a result of monitoring in cases
2224 involving family violence defendants and victims who participate in
2325 a global positioning monitoring system under Article 17.292 or
2426 17.49, Code of Criminal Procedure.
2527 (c) The criminal justice division shall establish:
2628 (1) additional eligibility criteria for grant
2729 applicants;
2830 (2) grant application procedures;
2931 (3) guidelines relating to grant amounts;
3032 (4) procedures for evaluating grant applications; and
3133 (5) procedures for monitoring the use of a grant
3234 awarded under the program and ensuring compliance with any
3335 conditions of a grant.
3436 (d) The criminal justice division shall include in the
3537 biennial report required by Section 772.006(a)(9) a detailed
3638 reporting of the results and performance of the grant program
3739 administered under this section.
3840 (e) The criminal justice division may use any revenue
3941 available for purposes of this section.
4042 SECTION 2. This Act takes effect immediately if it receives
4143 a vote of two-thirds of all the members elected to each house, as
4244 provided by Section 39, Article III, Texas Constitution. If this
4345 Act does not receive the vote necessary for immediate effect, this
4446 Act takes effect September 1, 2017.
