44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to penalties imposed on a holder of an alcoholic beverage
77 license or permit.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 11.641, Alcoholic Beverage Code, is
1010 amended by adding Subsection (d) to read as follows:
1111 (d) Notwithstanding (c), the commission may seek to impose
1212 an administrative sanction against a permit or license holder when
1313 the administrative sanction arises from the same facts or
1414 circumstances as a criminal prosecution, so long as the sanction is
1515 not dependent on a finding of guilt for the commission of a criminal
1616 offense.
1717 SECTION 2. Section 11.641, Alcoholic Beverage Code, as
1818 amended by this Act, applies only to the imposition of an
1919 administrative sanction for a violation that occurs on or after the
2020 effective date of this Act. The imposition of a civil penalty,
2121 including cancellation of a permit, for a violation that occurs
2222 before the effective date of this Act is governed by the law in
2323 effect immediately before the effective date of this Act, and that
2424 law is continued in effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2017.
