55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the recording of certain personal information of voters
88 by election officials.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 63, Election Code, is amended by adding
1111 Section 63.0013 to read as follows:
1212 Sec. 63.0013. RECORDED DOCUMENTATION OF CERTAIN PERSONAL
1313 INFORMATION. (a) An election officer may copy documentation
1414 presented by a voter under Section 63.001(b) or record information
1515 from the documentation.
1616 (b) An election officer may photograph the entire face of a
1717 voter who is accepted for voting under this chapter, if:
1818 (1) the documentation presented by a voter under
1919 Section 63.001(b) is not documentation issued by the Department of
2020 Public Safety containing the person's photograph; or
2121 (2) the election official questions the authenticity
2222 of the documentation presented by a voter under Section 63.001(b),
2323 regardless of whether the documentation is issued by the Department
2424 of Public Safety and contains the person's photograph.
2525 (c) A voter may only be photographed under this section
2626 while being accepted for voting and may not be photographed while
2727 the voter is occupying a voting station.
2828 (d) Information copied or recorded under this section,
2929 including a photograph produced under Subsection (b), is
3030 confidential except for use in a criminal investigation or
3131 prosecution or a civil court proceeding.
3232 (e) All information collected under this section shall be
3333 provided to the secretary of state for election-related purposes.
3434 SECTION 2. This Act takes effect September 1, 2017.
