| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 63, Election Code, is amended by adding |
|---|
| 11 | 11 | | Section 63.0013 to read as follows: |
|---|
| 12 | 12 | | Sec. 63.0013. RECORDED DOCUMENTATION OF CERTAIN PERSONAL |
|---|
| 13 | 13 | | INFORMATION. (a) An election officer may copy documentation |
|---|
| 14 | 14 | | presented by a voter under Section 63.001(b) or record information |
|---|
| 15 | 15 | | from the documentation. |
|---|
| 16 | 16 | | (b) An election officer may photograph the entire face of a |
|---|
| 17 | 17 | | voter who is accepted for voting under this chapter, if: |
|---|
| 18 | 18 | | (1) the documentation presented by a voter under |
|---|
| 19 | 19 | | Section 63.001(b) is not documentation issued by the Department of |
|---|
| 20 | 20 | | Public Safety containing the person's photograph; or |
|---|
| 21 | 21 | | (2) the election official questions the authenticity |
|---|
| 22 | 22 | | of the documentation presented by a voter under Section 63.001(b), |
|---|
| 23 | 23 | | regardless of whether the documentation is issued by the Department |
|---|
| 24 | 24 | | of Public Safety and contains the person's photograph. |
|---|
| 25 | 25 | | (c) A voter may only be photographed under this section |
|---|
| 26 | 26 | | while being accepted for voting and may not be photographed while |
|---|
| 27 | 27 | | the voter is occupying a voting station. |
|---|
| 28 | 28 | | (d) Information copied or recorded under this section, |
|---|
| 29 | 29 | | including a photograph produced under Subsection (b), is |
|---|
| 30 | 30 | | confidential except for use in a criminal investigation or |
|---|
| 31 | 31 | | prosecution or a civil court proceeding. |
|---|
| 32 | 32 | | (e) All information collected under this section shall be |
|---|
| 33 | 33 | | provided to the secretary of state for election-related purposes. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2017. |
