77 relating to the certification of unopposed candidates for the board
88 of directors of the North Harris County Regional Water Authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2, Chapter 1029, Acts of the 76th
1111 Legislature, Regular Session, 1999, is amended by adding Section
1212 2.08 to read as follows:
1313 Sec. 2.08. ACTION ON CERTIFICATION OF UNOPPOSED CANDIDATES.
1414 (a) On receipt of the certification required by Section 2.052,
1515 Election Code, the board may declare each unopposed candidate for
1616 the board elected to the office.
1717 (b) If a declaration is made under Subsection (a), the
1818 election is not held for that candidate's voting district.
1919 (c) The ballots used at a separate election held at the same
2020 time as an election that would have been held if the candidates were
2121 not declared elected under this section shall include the offices
2222 and names of the candidates declared elected under this section
2323 listed separately after the measures or contested races in the
2424 separate election under the heading "Unopposed Candidates Declared
2525 Elected." The candidates shall be grouped in the same relative
2626 order prescribed for the ballot generally. No votes are cast in
2727 connection with the candidates.
2828 (d) The secretary of state by rule may prescribe any
2929 additional procedures necessary to accommodate a particular voting
3030 system or ballot style and to facilitate the efficient and
3131 cost-effective implementation of this section.
3232 (e) A certificate of election shall be issued to each
3333 candidate in the same manner and at the same time as provided for a
3434 candidate elected at the election. The candidate must qualify for
3535 the office in the same manner as provided for a candidate elected at
3636 the election.
3737 (f) Section 2.053, Election Code, does not apply to an
3838 election for the board of directors of the authority.
3939 SECTION 2. This Act takes effect September 1, 2017.
