97 relating to the eligibility of certain municipalities to establish
108 homestead preservation districts and reinvestment zones.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 373A.003, Local Government Code, is
1311 amended to read as follows:
1412 Sec. 373A.003. APPLICABILITY OF CHAPTER. (a) Except as
1513 provided by Subsection (b), this [This] chapter applies to a
16- municipality with a population of more than 750,000 and less than 2
17- million [that is located in a uniform state service region with
18- fewer than 550,000 occupied housing units as determined by the most
19- recent United States decennial census].

2018 (b) Subchapter E does not [Subchapters A, B, C, and D] apply
2119 to any municipality with a population of 1.18 million or more which
2220 is located predominantly in a county that has a total area of less
2321 than 1,000 square miles and has adopted an urban land bank
2422 demonstration program under Chapter 379C, Local Government Code.
2523 SECTION 2. Sections 373A.052(a) and (b), Local Government
2624 Code, are amended to read as follows:
2725 (a) To be designated as a district within a municipality
2826 described by Section 373A.003(a) under this subchapter, an area
2927 must be composed of census tracts forming a spatially compact area
3028 with:
3129 (1) fewer than 75,000 residents;
3230 (2) an overall poverty rate of at least 25 percent
3331 [that is at least two times the poverty rate for the entire
3432 municipality]; and
3533 (3) in each census tract within the area, a median
3634 family income that is less than 80 percent of the median family
3735 income for the entire municipality.
3836 (b) To be designated as a district within a municipality
3937 described by Section 373A.003(b) under this subchapter, an area
4038 must be composed of census tracts forming a spatially compact area
4139 contiguous to a central business district and with:
4240 (1) fewer than 75,000 residents;
4341 (2) a median family income that is less than $30,000
4442 according to the last decennial census; and
4543 (3) an overall poverty rate of at least 25 percent
4644 [that is at least two times the poverty rate for the entire
4745 municipality].
4846 SECTION 3. This Act takes effect September 1, 2017.
