| 11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 10 | | SECTION 1. Section 373A.003, Local Government Code, is |

| 13 | 11 | | amended to read as follows: |

| 14 | 12 | | Sec. 373A.003. APPLICABILITY OF CHAPTER. (a) Except as |

| 25 | 23 | | SECTION 2. Sections 373A.052(a) and (b), Local Government |

| 26 | 24 | | Code, are amended to read as follows: |

| 27 | 25 | | (a) To be designated as a district within a municipality |
|---|
| 28 | 26 | | described by Section 373A.003(a) under this subchapter, an area |
|---|
| 29 | 27 | | must be composed of census tracts forming a spatially compact area |
|---|
| 30 | 28 | | with: |
|---|
| 31 | 29 | | (1) fewer than 75,000 residents; |
|---|
| 32 | 30 | | (2) an overall poverty rate of at least 25 percent |
|---|
| 33 | 31 | | [that is at least two times the poverty rate for the entire |
|---|
| 34 | 32 | | municipality]; and |
|---|
| 35 | 33 | | (3) in each census tract within the area, a median |
|---|
| 36 | 34 | | family income that is less than 80 percent of the median family |
|---|
| 37 | 35 | | income for the entire municipality. |

| 38 | 36 | | (b) To be designated as a district within a municipality |
|---|
| 39 | 37 | | described by Section 373A.003(b) under this subchapter, an area |
|---|
| 40 | 38 | | must be composed of census tracts forming a spatially compact area |
|---|
| 41 | 39 | | contiguous to a central business district and with: |
|---|
| 42 | 40 | | (1) fewer than 75,000 residents; |
|---|
| 43 | 41 | | (2) a median family income that is less than $30,000 |
|---|
| 44 | 42 | | according to the last decennial census; and |
|---|
| 45 | 43 | | (3) an overall poverty rate of at least 25 percent |
|---|
| 46 | 44 | | [that is at least two times the poverty rate for the entire |
|---|
| 47 | 45 | | municipality]. |

| 48 | 46 | | SECTION 3. This Act takes effect September 1, 2017. |
