9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 108.002(6), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (6) "Data" means information collected under Section |
---|
13 | 13 | | 108.0065, 108.0066, or 108.009 in the form initially received. |
---|
14 | 14 | | SECTION 2. Chapter 108, Health and Safety Code, is amended |
---|
15 | 15 | | by adding Section 108.0066 to read as follows: |
---|
16 | 16 | | Sec. 108.0066. BIRTH RECORD DATA. (a) In this section, |
---|
17 | 17 | | "birth record data" means the data associated with the birth of an |
---|
18 | 18 | | infant, including: |
---|
19 | 19 | | (1) information from the mother's prenatal care |
---|
20 | 20 | | visits; |
---|
21 | 21 | | (2) the number of previous live births or miscarriages |
---|
22 | 22 | | of the mother; |
---|
23 | 23 | | (3) the gestational age of the infant; |
---|
24 | 24 | | (4) the infant's birth weight; |
---|
25 | 25 | | (5) whether the infant is breast-fed in the hospital; |
---|
26 | 26 | | and |
---|
27 | 27 | | (6) whether the mother smoked during the pregnancy. |
---|
28 | 28 | | (b) The department shall collect birth record data under |
---|
29 | 29 | | this chapter. The department may coordinate the collection of the |
---|
30 | 30 | | data with local registrars and the vital statistics unit of the |
---|
31 | 31 | | department. If the department requires additional birth record |
---|
32 | 32 | | data, a hospital shall provide to the department the data required |
---|
33 | 33 | | by the department in the form required by the department. |
---|
34 | 34 | | (c) Dissemination of data collected under this section is |
---|
35 | 35 | | subject to Sections 108.010, 108.011, 108.012, 108.013, 108.014, |
---|
36 | 36 | | and 108.0141. |
---|
37 | 37 | | (d) The department shall include the birth record data |
---|
38 | 38 | | collected under this section with hospital inpatient public use |
---|
39 | 39 | | data. The department shall cross-reference the birth record data of |
---|
40 | 40 | | an infant with the appropriate hospital inpatient data for the |
---|
41 | 41 | | patient giving birth to the infant to: |
---|
42 | 42 | | (1) increase the accuracy of the data; |
---|
43 | 43 | | (2) reduce incomplete data; and |
---|
44 | 44 | | (3) support research of maternal and newborn deaths |
---|
45 | 45 | | and complications. |
---|
46 | 46 | | SECTION 3. Not later than June 1, 2018, the Department of |
---|
47 | 47 | | State Health Services shall: |
---|
48 | 48 | | (1) collect birth record data described by Section |
---|
49 | 49 | | 108.0066, Health and Safety Code, as added by this Act, for the |
---|
50 | 50 | | period beginning January 1, 2010, through the second quarter of the |
---|
51 | 51 | | year 2017; |
---|
52 | 52 | | (2) cross-reference the birth record data described by |
---|
53 | 53 | | Subdivision (1) with the appropriate hospital inpatient public use |
---|
54 | 54 | | data as described by Section 108.0066(d), Health and Safety Code, |
---|
55 | 55 | | as added by this Act; and |
---|
56 | 56 | | (3) incorporate the data described by Subdivisions (1) |
---|
57 | 57 | | and (2) into the public use data provided by the department. |
---|
58 | 58 | | SECTION 4. This Act takes effect September 1, 2017. |
