66 AN ACT
77 relating to birth record information included in certain health
88 care data collection.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 108.002(6), Health and Safety Code, is
1111 amended to read as follows:
1212 (6) "Data" means information collected under Section
1313 108.0065, 108.0066, or 108.009 in the form initially received.
1414 SECTION 2. Chapter 108, Health and Safety Code, is amended
1515 by adding Section 108.0066 to read as follows:
1616 Sec. 108.0066. BIRTH RECORD DATA. (a) In this section,
1717 "birth record data" means the data associated with the birth of an
1818 infant, including:
1919 (1) information from the mother's prenatal care
2020 visits;
2121 (2) the number of previous live births or miscarriages
2222 of the mother;
2323 (3) the gestational age of the infant;
2424 (4) the infant's birth weight;
2525 (5) whether the infant is breast-fed in the hospital;
2626 and
2727 (6) whether the mother smoked during the pregnancy.
2828 (b) The department shall collect birth record data under
2929 this chapter. The department may coordinate the collection of the
3030 data with local registrars and the vital statistics unit of the
3131 department. If the department requires additional birth record
3232 data, a hospital shall provide to the department the data required
3333 by the department in the form required by the department.
3434 (c) Dissemination of data collected under this section is
3535 subject to Sections 108.010, 108.011, 108.012, 108.013, 108.014,
3636 and 108.0141.
3737 (d) The department shall include the birth record data
3838 collected under this section with hospital inpatient public use
3939 data. The department shall cross-reference the birth record data of
4040 an infant with the appropriate hospital inpatient data for the
4141 patient giving birth to the infant to:
4242 (1) increase the accuracy of the data;
4343 (2) reduce incomplete data; and
4444 (3) support research of maternal and newborn deaths
4545 and complications.
4646 SECTION 3. Not later than June 1, 2018, the Department of
4747 State Health Services shall:
4848 (1) collect birth record data described by Section
4949 108.0066, Health and Safety Code, as added by this Act, for the
5050 period beginning January 1, 2010, through the second quarter of the
5151 year 2017;
5252 (2) cross-reference the birth record data described by
5353 Subdivision (1) with the appropriate hospital inpatient public use
5454 data as described by Section 108.0066(d), Health and Safety Code,
5555 as added by this Act; and
5656 (3) incorporate the data described by Subdivisions (1)
5757 and (2) into the public use data provided by the department.
5858 SECTION 4. This Act takes effect September 1, 2017.
