55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the availability on the Internet of personal financial
88 statements filed by public officials.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 572.032, Government Code, is amended by
1111 amending Subsections (a) and (c) and adding Subsection (a-2) to
1212 read as follows:
1313 (a) Financial statements filed under this subchapter are
1414 public records. The commission shall maintain the statements in
1515 separate alphabetical files and in a manner that is accessible to
1616 the public during regular office hours and make the statements
1717 available to the public on the commission's Internet website.
1818 (a-2) The commission shall redact the home address of an
1919 individual from a financial statement filed by the individual under
2020 this subchapter before making the statement available to the public
2121 on the commission's Internet website. This redaction is only for
2222 the purpose of making the statement available on the website, and
2323 the commission may not otherwise redact that information from the
2424 statement.
2525 (c) After the second anniversary of the date the individual
2626 ceases to be a state officer, the commission may and on notification
2727 from the former state officer shall:
2828 (1) destroy each financial statement filed by the
2929 state officer; and
3030 (2) remove each financial statement filed by the state
3131 officer from the commission's Internet website.
3232 SECTION 2. Section 145.007, Local Government Code, is
3333 amended by adding Subsection (d) to read as follows:
3434 (d) If a municipality makes financial statements filed
3535 under this chapter available to the public on the municipality's
3636 Internet website, the clerk or secretary of the municipality shall
3737 redact the home address of an individual filing a statement before
3838 making the statement available on the website. This redaction is
3939 only for the purpose of making the statement available on the
4040 website, and the clerk or secretary of the municipality may not
4141 otherwise redact that information from the statement.
4242 SECTION 3. Section 159.007, Local Government Code, is
4343 amended by adding Subsection (d) to read as follows:
4444 (d) If a county makes financial statements filed under this
4545 subchapter available to the public on the county's Internet
4646 website, the county clerk shall redact the home address of an
4747 individual filing a statement before making the statement available
4848 on the website. This redaction is only for the purpose of making
4949 the statement available on the website, and the county clerk may not
5050 otherwise redact that information from the statement.
5151 SECTION 4. Subchapter B, Chapter 159, Local Government
5252 Code, is amended by adding Section 159.0342 to read as follows:
5353 Sec. 159.0342. REDACTION OF INFORMATION FROM REPORTS
5454 AVAILABLE TO PUBLIC ON INTERNET. If a county makes reports filed
5555 under this subchapter available to the public on the county's
5656 Internet website, the authority with whom the report is filed shall
5757 redact the home address of an individual filing a report before
5858 making the report available on the website. This redaction is only
5959 for the purpose of making the report available on the website, and
6060 the authority with whom the report is filed may not otherwise redact
6161 that information from the report.
6262 SECTION 5. Section 159.055, Local Government Code, is
6363 amended by adding Subsection (e) to read as follows:
6464 (e) If a county makes financial statements filed under this
6565 subchapter available to the public on the county's Internet
6666 website, the county clerk shall redact the home address of an
6767 individual filing a statement before making the statement available
6868 on the website. This redaction is only for the purpose of making
6969 the statement available on the website, and the county clerk may not
7070 otherwise redact that information from the statement.
7171 SECTION 6. As soon as practicable after the effective date
7272 of this Act, the Texas Ethics Commission shall make the financial
7373 statements filed under Subchapter B, Chapter 572, Government Code,
7474 available on the commission's Internet website, as provided by the
7575 changes in law made by this Act.
7676 SECTION 7. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2017.
