9- relating to waiver of continuing education requirements for certain
10- insurance adjusters.
6+ relating to continuing education requirements of independent
7+ adjusters and licensing related thereto.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 4101.060, Insurance Code, is amended by
13- adding Subsection (d) to read as follows:
14- (d) Notwithstanding Section 4004.051, the department shall
15- waive any continuing education requirement imposed under this
16- chapter or Chapter 4004 for an adjuster who, during the license
17- period for which the continuing education is required, receives a
18- certificate of completion of a continuing education program issued
19- by a professional organization of adjusters if:
20- (1) the number of hours required to complete the
21- continuing education program is not less than the number of hours of
22- continuing education that an adjuster is required to complete
23- during the license period under Sections 4004.053 and 4004.054; and
24- (2) the content of the continuing education program
25- includes the content required under Section 4004.105.
26- SECTION 2. (a) Not later than December 1, 2017, the
27- commissioner of insurance shall adopt the rules necessary to
28- implement Section 4101.060(d), Insurance Code, as added by this
29- Act.
30- (b) The change in law made by Section 4101.060(d), as added
31- by this Act, applies to continuing education requirements for an
32- insurance adjuster's license period beginning on or after January
33- 1, 2018.
34- SECTION 3. This Act takes effect September 1, 2017.
9+ SECTION 3. Sec. 4101.060, Insurance Code, is amended to
10+ read as follows:
11+ (c) The department may waive any continuing education
12+ requirement imposed under this chapter for
13+ ;
14+ (1) a nonresident adjuster who holds a valid license
15+ from another state if the state has continuing education
16+ requirements substantially equivalent to the requirements for a
17+ license issued under this chapter.; or
18+ (2) a resident or nonresident adjuster who holds a
19+ certification from a nationally recognized insurance claims
20+ association with at least 10,000 members and 5 years or more
21+ experience providing extensive adjuster educational and training
22+ services and determined by the commissioner to require, as a
23+ condition to maintenance of such certification, continuing
24+ education requirements equal to or exceeding the requirements of ยง
25+ 4101.059, Insurance Code.
26+ SECTION 4. This Act takes effect immediately if it receives
27+ a vote of two-thirds of all the members elected to each house, as
28+ provided by Section 39, Article III, Texas Constitution. If this
29+ Act does not receive the vote necessary for immediate effect, this
30+ Act takes effect September 1, 2017.
