10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 75.007(e), Civil Practice and Remedies | |
12 | 12 | Code, is amended to read as follows: | |
13 | 13 | (e) This section does not affect Section 75.001, 75.002, | |
14 | 14 | [75.0021,] 75.003, or 75.004 or create or increase the liability of | |
15 | 15 | any person. | |
16 | 16 | SECTION 2. Sections 75.0021 and 75.0022(b), Civil Practice | |
17 | 17 | and Remedies Code, are repealed. | |
18 | 18 | SECTION 3. The change in law made by this Act applies only | |
19 | 19 | to a cause of action that accrues on or after the effective date of | |
20 | 20 | this Act. A cause of action that accrues before the effective date | |
21 | 21 | of this Act is governed by the law applicable to the cause of action | |
22 | 22 | immediately before that date, and that law is continued in effect | |
23 | 23 | for that purpose. | |
24 | 24 | SECTION 4. This Act takes effect immediately if it receives | |
25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
28 | 28 | Act takes effect September 1, 2017. |
