| 8 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 16 | | SECTION 1. Section 113.087(m), Natural Resources Code, is |
|---|
| 10 | 17 | | amended to read as follows: |
|---|
| 11 | 18 | | (m) The commission[,] by [appropriate] rule may[, shall] |
|---|
| 12 | 19 | | require, in addition to examination requirements as set out in |
|---|
| 13 | 20 | | Subsections (b), (c), and (d) [of this section]: |
|---|
| 14 | 21 | | (1) an examination for technical competence that is |
|---|
| 15 | 22 | | validated by a recognized educational testing organization or |
|---|
| 16 | 23 | | similar organization; or |
|---|
| 17 | 24 | | (2) attendance at approved academic, trade, |
|---|
| 18 | 25 | | professional, or commission-sponsored seminars or[,] other |
|---|
| 19 | 26 | | continuing education programs[, and periodic reexaminations]. |
|---|
| 20 | 27 | | SECTION 2. Section 113.087, Natural Resources Code, as |
|---|
| 21 | 28 | | amended by this Act, applies only to an application for an original |
|---|
| 22 | 29 | | or renewal license submitted on or after the effective date of this |
|---|
| 23 | 30 | | Act. An application submitted before that date is governed by the |
|---|
| 24 | 31 | | law in effect on the date the application was submitted, and the |
|---|
| 25 | 32 | | former law is continued in effect for that purpose. |
|---|
| 26 | 33 | | SECTION 3. This Act takes effect September 1, 2017. |
