6	6	AN ACT
7	7	relating to an insurer's compliance with National Association of
8	8	Insurance Commissioners requirements.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 36.004, Insurance Code, is amended to
11	11	read as follows:
12	12	Sec. 36.004. COMPLIANCE WITH NATIONAL ASSOCIATION OF
13	13	INSURANCE COMMISSIONERS REQUIREMENTS. (a) Except as provided by
14	14	Section 36.005 and notwithstanding any other law, the department
15	15	may not require an insurer to comply with a rule, regulation,
16	16	directive, or standard adopted by the National Association of
17	17	Insurance Commissioners, including a rule, regulation, directive,
18	18	or standard relating to policy reserves, unless application of that
19	19	version of the rule, regulation, directive, or standard is
20	20	expressly authorized by statute [and approved by the commissioner].
21	21	(b) For purposes of Subsection (a), a version of a rule,
22	22	regulation, directive, or standard is expressly authorized by
23	23	statute if:
24	24	(1) the statute explicitly authorizes that version; or
25	25	(2) that version is the latest version of the rule,
26	26	regulation, directive, or standard on the date that the statute was
27	27	enacted.
28	28	SECTION 2. This Act takes effect immediately if it receives
29	29	a vote of two-thirds of all the members elected to each house, as
30	30	provided by Section 39, Article III, Texas Constitution. If this
31	31	Act does not receive the vote necessary for immediate effect, this
32	32	Act takes effect September 1, 2017.
