66 AN ACT
77 relating to the dissemination of information about historically
88 underutilized businesses and the expansion of the small business
99 development center network.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 61.8235, Education Code, is amended by
1212 adding Subsection (b-1) to read as follows:
1313 (b-1) In developing the career and technical education
1414 program of study curricula under Subsection (b), the board shall
1515 ensure that the curricula include information about historically
1616 underutilized businesses and the certification procedure for and
1717 the assistance available to historically underutilized businesses
1818 under Chapter 2161, Government Code.
1919 SECTION 2. Section 481.0068(b), Government Code, is amended
2020 to read as follows:
2121 (b) The Office of Small Business Assistance shall:
2222 (1) examine the role of small and historically
2323 underutilized businesses in the state's economy and the
2424 contribution of small and historically underutilized businesses in
2525 generating economic activity, expanding employment opportunities,
2626 promoting exports, stimulating innovation and entrepreneurship,
2727 and bringing new and untested products and services to the
2828 marketplace;
2929 (2) serve as the principal focal point in the state for
3030 small and historically underutilized businesses by:
3131 (A) providing to the legislature information on
3232 the effects of proposed policies or actions;
3333 (B) assisting state agencies in determining the
3434 impact proposed rules have on small businesses as required by
3535 Section 2006.002; and
3636 (C) assisting the agencies in reducing the
3737 adverse effect that rules have on small businesses, if appropriate;
3838 (3) evaluate the effectiveness of efforts of state
3939 agencies and other entities to assist small and historically
4040 underutilized businesses and make appropriate recommendations to
4141 the legislature and state agencies to assist the development and
4242 strengthening of small and historically underutilized businesses;
4343 (4) identify regulations that inhibit small and
4444 historically underutilized business development and to the extent
4545 possible identify conflicting state policy goals;
4646 (5) determine the availability of financial and other
4747 resources to small and historically underutilized businesses and
4848 recommend methods for:
4949 (A) increasing the availability of equity
5050 capital and other forms of financial assistance to small and
5151 historically underutilized businesses;
5252 (B) generating markets for the goods and services
5353 of small and historically underutilized businesses;
5454 (C) providing more effective education,
5555 training, and management and technical assistance to small and
5656 historically underutilized businesses; and
5757 (D) providing assistance to small and
5858 historically underutilized businesses in complying with federal,
5959 state, and local laws;
6060 (6) identify the reasons for small and historically
6161 underutilized business successes and failures, ascertain the
6262 related factors that are particularly important in this state, and
6363 recommend actions for increasing the success rate of small and
6464 historically underutilized businesses;
6565 (7) serve as a focal point for receiving comments and
6666 suggestions concerning state government policies and activities
6767 that affect small and historically underutilized businesses;
6868 (8) develop and suggest proposals for changes in state
6969 policies and activities that adversely affect small and
7070 historically underutilized businesses;
7171 (9) provide to state agencies information on the
7272 effects of proposed policies or actions that affect small and
7373 historically underutilized businesses;
7474 (10) provide information and assistance relating to
7575 establishing, operating, or expanding small and historically
7676 underutilized businesses;
7777 (11) assist small and historically underutilized
7878 businesses by:
7979 (A) identifying:
8080 (i) sources of financial assistance for
8181 those businesses; and
8282 (ii) financial barriers to those
8383 businesses;
8484 (B) working with relevant organizations to
8585 identify financing programs that aid small businesses in overcoming
8686 financial barriers;
8787 (C) matching those businesses with sources of
8888 financial assistance and credit enhancement; and
8989 (D) assisting those businesses with the
9090 preparation of applications for government loans, loan guarantees,
9191 and credit enhancement programs;
9292 (12) sponsor meetings, to the extent practicable in
9393 cooperation with public and private educational institutions, to
9494 provide training and disseminate information beneficial to small
9595 and historically underutilized businesses;
9696 (13) assist small and historically underutilized
9797 businesses in their dealings with federal, state, and local
9898 governmental agencies and provide information regarding
9999 governmental requirements affecting small and historically
100100 underutilized businesses;
101101 (14) perform research, studies, and analyses of
102102 matters affecting the interests of small and historically
103103 underutilized businesses;
104104 (15) use available resources within the state, such as
105105 small business development centers, educational institutions, and
106106 nonprofit associations, to coordinate the provision of management
107107 and technical assistance to small and historically underutilized
108108 businesses in a systematic manner;
109109 (16) publish newsletters, brochures, and other
110110 documents containing information useful to small and historically
111111 underutilized businesses;
112112 (17) identify successful small and historically
113113 underutilized business assistance programs provided by other
114114 states and determine the feasibility of adapting those programs for
115115 implementation in this state;
116116 (18) establish an outreach program to make the
117117 existence of the office known to small and historically
118118 underutilized businesses and potential clients throughout the
119119 state;
120120 (19) enlist the cooperation and assistance of public
121121 and private agencies, businesses, and other organizations in
122122 disseminating information about the programs and services provided
123123 by the state that benefit small businesses and how small businesses
124124 can participate in or make use of those programs and services;
125125 (20) defer to the small business compliance assistance
126126 program as defined by Section 5.135, Water Code, on advocacy and
127127 technical assistance related to environmental programs that
128128 regulate small businesses;
129129 (21) develop a "one-stop" approach for all small
130130 business needs, including competitive activity with state agencies
131131 and political subdivisions; [and]
132132 (22) promote the establishment of small business
133133 development centers at accessible locations, including community
134134 centers, park facilities, and public libraries, in areas of the
135135 state with the fewest number of certified historically
136136 underutilized businesses; and
137137 (23) perform any other functions necessary to carry
138138 out the purposes of this section.
139139 SECTION 3. Subchapter B, Chapter 2161, Government Code, is
140140 amended by adding Section 2161.067 to read as follows:
141141 Sec. 2161.067. PUBLICITY. The comptroller shall publicize,
142142 including through social media, the certification procedure for
143143 historically underutilized businesses under this chapter and
144144 opportunities for historically underutilized businesses to obtain
145145 assistance and guidance, including through economic opportunity
146146 forums.
147147 SECTION 4. This Act takes effect September 1, 2017.
