8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 434, Government Code, is amended by | |
10 | 10 | adding Subchapter J to read as follows: | |
11 | 11 | SUBCHAPTER J. BENEFITS FOR SPOUSES OF VETERANS | |
12 | 12 | Sec. 434.451. APPLICABILITY. | |
13 | 13 | This subchapter applies only | |
14 | 14 | to the spouse or former spouse of a veteran, as defined by Section | |
15 | 15 | 2303.003, who was married for at least 10 years to the veteran while | |
16 | 16 | the veteran served on active duty as a member of the state military | |
17 | 17 | forces or a component of the United States armed forces, including | |
18 | 18 | an auxiliary service of one of those branches. | |
19 | 19 | Sec. 434.452. ENTITLEMENT TO STATE MENTAL HEALTH BENEFITS. | |
20 | 20 | Notwithstanding the applicability of any other law, the spouse or | |
21 | 21 | former spouse of a veteran to whom this subchapter applies is | |
22 | 22 | entitled to the mental health benefits to which a veteran is | |
23 | 23 | entitled under state law. | |
24 | 24 | SECTION 2. The changes in law made by this Act apply to an | |
25 | 25 | application for a state mental health benefit that is submitted by a | |
26 | 26 | spouse or former spouse of a veteran on or after the effective date | |
27 | 27 | of this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2017. |
