44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to state mental health benefits provided to certain
77 spouses or former spouses of veterans.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 434, Government Code, is amended by
1010 adding Subchapter J to read as follows:
1111 SUBCHAPTER J. BENEFITS FOR SPOUSES OF VETERANS
1212 Sec. 434.451. APPLICABILITY.
1313 This subchapter applies only
1414 to the spouse or former spouse of a veteran, as defined by Section
1515 2303.003, who was married for at least 10 years to the veteran while
1616 the veteran served on active duty as a member of the state military
1717 forces or a component of the United States armed forces, including
1818 an auxiliary service of one of those branches.
1919 Sec. 434.452. ENTITLEMENT TO STATE MENTAL HEALTH BENEFITS.
2020 Notwithstanding the applicability of any other law, the spouse or
2121 former spouse of a veteran to whom this subchapter applies is
2222 entitled to the mental health benefits to which a veteran is
2323 entitled under state law.
2424 SECTION 2. The changes in law made by this Act apply to an
2525 application for a state mental health benefit that is submitted by a
2626 spouse or former spouse of a veteran on or after the effective date
2727 of this Act.
2828 SECTION 3. This Act takes effect September 1, 2017.
