| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 411.0255(d), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (d) The prosecutor selected under this section may pursue a | |
| 13 | 13 | waiver to extend the statute of limitations by no more than two | |
| 14 | 14 | years. | |
| 15 | 15 | The waiver is only valid if it is in writing, specifies the | |
| 16 | 16 | end date of the waiver, and is signed by the prosecuting attorney | |
| 17 | 17 | and the defendant or the defendant's counsel. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2017. |
