| 6 | 6 | | relating to a temporary exemption for a school district from the |

| 7 | 7 | | obligation to comply with certain unfunded state educational |
|---|
| 8 | 8 | | mandates. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 11, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 11.005 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.005. EXEMPTION FROM CERTAIN STATE EDUCATIONAL |
|---|
| 13 | 13 | | MANDATES. (a) In this section, "state educational mandate" means a |
|---|
| 14 | 14 | | statutory provision the implementation of which requires an |
|---|
| 15 | 15 | | expenditure by a school district that would not have been required |
|---|
| 16 | 16 | | in the absence of the statutory provision or a rule adopted under |
|---|
| 17 | 17 | | that provision. |
|---|
| 18 | 18 | | (b) For the 2018-2019 and 2019-2020 school years, a school |
|---|
| 19 | 19 | | district is exempt from the following state educational mandates |
|---|
| 20 | 20 | | for which the legislature has not appropriated money estimated to |
|---|
| 21 | 21 | | be sufficient to meet the expenditure required by the mandate: |
|---|
| 22 | 22 | | (1) the following provisions of the Education Code: |
|---|
| 23 | 23 | | (A) Section 11.158(b)(7); |
|---|
| 24 | 24 | | (B) Section 25.112; |
|---|
| 25 | 25 | | (C) Section 28.002(c-1); |
|---|
| 26 | 26 | | (D) Section 28.0021; |
|---|
| 27 | 27 | | (E) Section 28.0023; |
|---|
| 28 | 28 | | (F) Section 28.0024(c); |
|---|
| 29 | 29 | | (G) Section 28.004(k); |

| 54 | 54 | | (3) the following provisions of the Health and Safety |
|---|
| 55 | 55 | | Code: |
|---|
| 56 | 56 | | (A) Sections 361.425 and 361.426; and |
|---|
| 57 | 57 | | (B) Sections 382.202 and 382.203; and |
|---|
| 58 | 58 | | (4) Section 1951.212, Occupations Code. |
|---|
| 59 | 59 | | (c) This section expires September 1, 2020. |
|---|
| 60 | 60 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 61 | 61 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 62 | 62 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 63 | 63 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 64 | 64 | | Act takes effect September 1, 2017. |
