8 | 8 | | provide advice to the legislature on the effective use of state |
---|
9 | 9 | | resources. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subtitle B, Title 10, Government Code, is |
---|
12 | 12 | | amended by adding Chapter 2061 to read as follows: |
---|
13 | 13 | | CHAPTER 2061. TEXAS FIRST CENTER |
---|
14 | 14 | | Sec. 2061.0001. DEFINITIONS. In this chapter: |
---|
15 | 15 | | (1) "Board" means the Texas First Center Board. |
---|
16 | 16 | | (2) "Center" means the Texas First Center. |
---|
17 | 17 | | (3) "State agency" means a department, commission, |
---|
18 | 18 | | board, office, or other agency in the executive or judicial branch |
---|
19 | 19 | | of state government that is created under the constitution or a |
---|
20 | 20 | | statute of this state. The term includes an institution of higher |
---|
21 | 21 | | education as defined by Section 61.003, Education Code. |
---|
22 | 22 | | Sec. 2061.0002. TEXAS FIRST CENTER. (a) The Texas First |
---|
23 | 23 | | Center is created as an independent policy center for the primary |
---|
24 | 24 | | purpose of advising this state's legislature. |
---|
25 | 25 | | (b) The center shall represent the interests of the |
---|
26 | 26 | | residents of this state by studying the effect of resource |
---|
27 | 27 | | allocation on the performance of state agencies and other public |
---|
28 | 28 | | institutions using applicable state and national data. |
---|
29 | 29 | | (c) In performing the duties assigned by this chapter, the |
---|
30 | 30 | | center shall work directly with: |
---|
31 | 31 | | (1) the governor, lieutenant governor, speaker of the |
---|
32 | 32 | | house of representatives, and members of the legislature; and |
---|
33 | 33 | | (2) state agencies and other public institutions. |
---|
34 | 34 | | Sec. 2061.0003. CENTER DUTIES. (a) The center shall use |
---|
35 | 35 | | analytics standards used by business, finance, public policy, and |
---|
36 | 36 | | other interests considered appropriate by the center to determine |
---|
37 | 37 | | the relationship between resource allocation and performance |
---|
38 | 38 | | outcomes of state agencies and other public institutions. |
---|
39 | 39 | | (b) The center shall develop a schedule so that each year |
---|
40 | 40 | | the center evaluates the performance of selected state agencies and |
---|
41 | 41 | | other public institutions and provides a progress report on those |
---|
42 | 42 | | agencies and institutions to: |
---|
43 | 43 | | (1) the governor, lieutenant governor, and speaker of |
---|
44 | 44 | | the house of representatives; and |
---|
45 | 45 | | (2) responsible parties at each agency or institution |
---|
46 | 46 | | being evaluated. |
---|
47 | 47 | | (c) The center may assist the legislature with policy |
---|
48 | 48 | | studies related to the center's duties. The center may participate |
---|
49 | 49 | | in collaborative studies with a foundation or organization inside |
---|
50 | 50 | | or outside this state related to the center's duties. |
---|
51 | 51 | | (d) The center shall seek information, data, and best |
---|
52 | 52 | | practices from state, regional, and national sources to use in |
---|
53 | 53 | | performing the center's duties under this chapter. |
---|
54 | 54 | | (e) The center may contract with independent experts, |
---|
55 | 55 | | academic scholars, and other appropriate professionals in |
---|
56 | 56 | | performing the center's duties under this chapter. |
---|
57 | 57 | | Sec. 2061.0004. TEXAS FIRST CENTER BOARD. (a) The Texas |
---|
58 | 58 | | First Center Board is created as the primary policy-making body of |
---|
59 | 59 | | the center. |
---|
60 | 60 | | (b) The board is composed of three members appointed by the |
---|
61 | 61 | | governor. |
---|
62 | 62 | | (c) Board members must include individuals in the private |
---|
63 | 63 | | sector who have an interest in improving the performance of state |
---|
64 | 64 | | agencies and other public institutions and significant experience |
---|
65 | 65 | | in organizational management, finance, or business. A board member |
---|
66 | 66 | | may not have a financial relationship with a vendor who provides |
---|
67 | 67 | | goods or services to an agency or institution of this state. |
---|
68 | 68 | | (d) Board members serve four-year terms. |
---|
69 | 69 | | (e) Board members shall annually elect one member as the |
---|
70 | 70 | | presiding officer. |
---|
71 | 71 | | (f) A board member may not receive a salary for services as a |
---|
72 | 72 | | board member but shall be reimbursed for expenses incurred in |
---|
73 | 73 | | attending board meetings. |
---|
74 | 74 | | Sec. 2061.0005. BOARD DUTIES. (a) In addition to the |
---|
75 | 75 | | evaluation and report required under Section 2061.0003(b), the |
---|
76 | 76 | | board shall study effective and efficient systems for the operation |
---|
77 | 77 | | of state agencies and other public institutions and make |
---|
78 | 78 | | recommendations to: |
---|
79 | 79 | | (1) improve the performance of agencies and |
---|
80 | 80 | | institutions to meet the demands of the current century; |
---|
81 | 81 | | (2) improve this state's ability to compete with other |
---|
82 | 82 | | states and countries; and |
---|
83 | 83 | | (3) provide the legislature and the public with |
---|
84 | 84 | | information on the performance of agencies and institutions. |
---|
85 | 85 | | (b) The board shall provide a report of the board's study |
---|
86 | 86 | | and recommendations under Subsection (a) to: |
---|
87 | 87 | | (1) the Legislative Budget Board at least once each |
---|
88 | 88 | | year; and |
---|
89 | 89 | | (2) the governor, lieutenant governor, and speaker of |
---|
90 | 90 | | the house of representatives not later than December 1 of each |
---|
91 | 91 | | even-numbered year. |
---|
92 | 92 | | Sec. 2061.0006. SUPPORT FOR PERFORMANCE OF DUTIES. (a) |
---|
93 | 93 | | State agencies and other public institutions shall fully cooperate |
---|
94 | 94 | | with and assist the center at the board's request. |
---|
95 | 95 | | (b) Data and information necessary to perform the center's |
---|
96 | 96 | | duties under this chapter shall be provided at the board's request |
---|
97 | 97 | | in a timely manner. The board and center shall maintain |
---|
98 | 98 | | confidentiality and other security measures for any requested data |
---|
99 | 99 | | and information. |
---|
100 | 100 | | Sec. 2061.0007. FUNDING. The center may be funded by |
---|
101 | 101 | | donations, grants, and legislative appropriations. |
---|
102 | 102 | | SECTION 2. As soon as practicable after the effective date |
---|
103 | 103 | | of this Act, the governor shall appoint the initial members of the |
---|
104 | 104 | | Texas First Center Board under Section 2061.0004, Government Code, |
---|
105 | 105 | | as added by this Act, to serve terms beginning January 1, 2018. |
---|
106 | 106 | | SECTION 3. The first reports required under Sections |
---|
107 | 107 | | 2061.0003(b) and 2061.0005(b)(1), Government Code, as added by this |
---|
108 | 108 | | Act, are due not later than December 1, 2018. |
---|
109 | 109 | | SECTION 4. This Act takes effect September 1, 2017. |
