55 AN ACT
66 relating to mandatory sales price disclosure in real property
77 sales; providing a civil penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 12, Property Code, is amended by adding
1010 Section 12.0013 to read as follows:
1111 Sec. 12.0013. MANDATORY SALES PRICE DISCLOSURE. (a) A
1212 person may not file for record or have recorded in the county

1414 's office an instrument conveying real property under a
1515 contract for sale unless the instrument discloses the sales price
1616 of the property.
1717 (b) The purchaser of any property for which an instrument is
1818 recorded in violation of Subsection (a) is liable to the state for a
1919 civil penalty for each violation in an amount equal to five percent
2020 of the sales price of the property.
2121 (c) The attorney general or the county or district attorney
2222 for the county in which the property is located may bring suit to
2323 recover a penalty under this section.
2424 (d) This section does not apply to an instrument conveying
2525 only a mineral interest in real property.
2626 SECTION 2. This section takes effect September 1, 2017.
