55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transfer of territory between junior college
88 district service areas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter J, Chapter 130, Education Code, is
1111 amended by adding Section 130.1615 to read as follows:
1212 Sec. 130.1615. TRANSFER OF SCHOOL DISTRICT TO NEW SERVICE
1313 AREA. (a) Notwithstanding any other provision of this subchapter,
1414 the board of trustees of an independent school district by
1515 resolution may transfer the territory of the school district from
1616 the service area of one junior college district to the service area
1717 of another junior college district if:
1818 (1) the board of trustees finds that another junior
1919 college district is willing to provide service to the residents of
2020 the school district and:
2121 (A) offers more affordable services;
2222 (B) offers a broader or more relevant selection
2323 of courses or programs; or
2424 (C) is otherwise better suited to meet the needs
2525 of the residents of the school district; and
2626 (2) the territory included in the service areas of the
2727 affected junior college districts is contiguous.
2828 (b) A transfer under this section does not affect the
2929 territory of an independent school district that is located within
3030 the boundaries of the taxing district of a junior college district.
3131 (c) A junior college district may continue to treat an area
3232 removed from the district's service area under this section as if
3333 the area were still in the district's service area during the first
3434 academic year following the adoption of the resolution as necessary
3535 to avoid an unreasonable interruption of junior college services in
3636 the area.
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2017.
