9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter J, Chapter 130, Education Code, is |
---|
11 | 11 | | amended by adding Section 130.1615 to read as follows: |
---|
12 | 12 | | Sec. 130.1615. TRANSFER OF SCHOOL DISTRICT TO NEW SERVICE |
---|
13 | 13 | | AREA. (a) Notwithstanding any other provision of this subchapter, |
---|
14 | 14 | | the board of trustees of an independent school district by |
---|
15 | 15 | | resolution may transfer the territory of the school district from |
---|
16 | 16 | | the service area of one junior college district to the service area |
---|
17 | 17 | | of another junior college district if: |
---|
18 | 18 | | (1) the board of trustees finds that another junior |
---|
19 | 19 | | college district is willing to provide service to the residents of |
---|
20 | 20 | | the school district and: |
---|
21 | 21 | | (A) offers more affordable services; |
---|
22 | 22 | | (B) offers a broader or more relevant selection |
---|
23 | 23 | | of courses or programs; or |
---|
24 | 24 | | (C) is otherwise better suited to meet the needs |
---|
25 | 25 | | of the residents of the school district; and |
---|
26 | 26 | | (2) the territory included in the service areas of the |
---|
27 | 27 | | affected junior college districts is contiguous. |

28 | 28 | | (b) A transfer under this section does not affect the |
---|
29 | 29 | | territory of an independent school district that is located within |
---|
30 | 30 | | the boundaries of the taxing district of a junior college district. |
---|
31 | 31 | | (c) A junior college district may continue to treat an area |
---|
32 | 32 | | removed from the district's service area under this section as if |
---|
33 | 33 | | the area were still in the district's service area during the first |
---|
34 | 34 | | academic year following the adoption of the resolution as necessary |
---|
35 | 35 | | to avoid an unreasonable interruption of junior college services in |
---|
36 | 36 | | the area. |
---|
37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
---|
38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
---|
39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
---|
41 | 41 | | Act takes effect September 1, 2017. |
