	13	+	A BILL TO BE ENTITLED
4	14		AN ACT
5	15		relating to the transfer of jurisdiction over and management of the
6	16		property known as the French Legation to the Texas Historical
7	17		Commission and to certain historic sites under the commission's
8	18		jurisdiction.
9	19		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	20		SECTION 1. Section 442.072(a), Government Code, is amended
11	21		to read as follows:
12	22		(a) The following historic sites and parks [formerly under
13	23		the jurisdiction of the Parks and Wildlife Department] are under
14	24		the commission's jurisdiction:
15	25		(1) Acton State Historic Site;
16	26		(2) Caddoan Mounds State Historic Site;
17	27		(3) Casa Navarro State Historic Site;
18	28		(4) Confederate Reunion Grounds State Historic Site;
19	29		(5) Eisenhower Birthplace State Historic Site;
20	30		(6) Fannin Battleground State Historic Site;
21	31		(7) Fort Griffin State Historic Site;
22	32		(8) Fort Lancaster State Historic Site;
23	33		(9) Fort McKavett State Historic Site;
24	34		(10) Fulton Mansion State Historic Site;
25	35		(11) Landmark Inn State Historic Site;
26	36		(12) Levi Jordan State Historic Site;
27	37		(13) Magoffin Home State Historic Site;
28	38		(14) Sabine Pass Battleground State Historic Site;
29	39		(15) Sam Bell Maxey House State Historic Site;
30	40		(16) San Felipe State Historic Site;
31	41		(17) Starr Family Home State Historic Site;

37	47		SECTION 2. Subchapter C, Chapter 442, Government Code, is
38	48		amended by adding Section 442.077 to read as follows:
39	49		Sec. 442.077. AGREEMENT RELATING TO FRENCH LEGATION. The
40	50		commission may enter into an agreement with the Daughters of the
41		-	Republic of Texas regarding the management, staffing, parking
42		-	facilities, operation, and financial support of the property known
43		-	as the French Legation.

44	53		SECTION 3. Section 2165.257, Government Code, is
45	54		transferred to Subchapter C, Chapter 442, Government Code,
46	55		redesignated as Section 442.076, Government Code, and amended to
47	56		read as follows:
48	57		Sec. 442.076 [2165.257]. FRENCH LEGATION [EMBASSY]. (a)
49	58		The commission is responsible for:
50	59		(1) the preservation, maintenance, and restoration of
51	60		the [The] property known as the French Legation and its contents;
52	61		and
53	62		(2) the protection of the historical and architectural
54	63		integrity of the exterior, interior, and grounds of the French
55	64		Legation [Embassy is for the use and purposes of the Daughters of
56	65		the Republic of Texas. They may take full charge of the building
57	66		and use it as they consider proper].
58	67		(b) Any power or duty related to the French Legation
59	68		formerly vested in another state agency or entity is vested solely
60	69		in the commission.
61	70		(c) The commission may solicit and accept gifts, donations,
62	71		and grants of money or property from any public or private source to
63	72		be used for the purposes of this section.
64	73		(d) In carrying out the commission's responsibilities under
65	74		this section during the state fiscal biennium ending August 31,
66	75		2019, the commission may use only money or property received as a
67	76		gift, donation, or grant from a public or private source. This
68	77		subsection expires September 1, 2019 [The French Embassy is the
69	78		property of the state, and title to the property remains in the
70	79		commission's custody].
71	80		SECTION 4. The heading to Section 2203.003, Government
72	81		Code, is amended to read as follows:
73	82		Sec. 2203.003. STATE PROPERTY UNDER CONTROL OF THE TEXAS
74	83		DIVISION UNITED DAUGHTERS OF THE CONFEDERACY[, TEXAS DIVISION, AND
75	84		THE DAUGHTERS OF THE REPUBLIC OF TEXAS].
76	85		SECTION 5. Section 2203.003(a), Government Code, is amended
77	86		to read as follows:
78	87		(a) The Texas Division United Daughters of the
79	88		Confederacy[, Texas Division, and the Daughters of the Republic of
80	89		Texas each] may charge admission to state property over which the
81	90		[each] organization has custody or control.
82	91		SECTION 6. (a) On September 1, 2017, or as soon as
83	92		practicable after that date, the Daughters of the Republic of Texas
84	93		with assistance from the Texas Facilities Commission shall take a
85	94		complete inventory of all personal property and fixtures located at
86	95		the property known as the French Legation. The inventory must
87	96		identify the origin of each item and its current owner as agreed to
88	97		between the Daughters of the Republic of Texas and the Texas
89	98		Facilities Commission. The Daughters of the Republic of Texas shall
90	99		be allowed a reasonable time after completion of the inventory to
91	100		remove any personal property and fixtures owned by the
92	101		organization.
93	102		(b) Any dispute regarding the ownership of personal
94	103		property and fixtures located at the French Legation shall be
95	104		resolved through alternative dispute resolution as provided by
96	105		Chapter 2009, Government Code.
97	106		(c) The Daughters of the Republic of Texas may transfer any
98	107		property of the organization described by this section to the Texas
99	108		Historical Commission.
100	109		SECTION 7. On September 1, 2017, the following are
101	110		transferred to the Texas Historical Commission:
102	111		(1) all powers and duties of the Daughters of the
103	112		Republic of Texas relating to the property known as the French
104	113		Legation;
105	114		(2) all state-owned assets in the possession of the
106	115		Daughters of the Republic of Texas relating to the French Legation;
107	116		and
108	117		(3) all files and other records of the Daughters of the
109	118		Republic of Texas kept by the organization regarding the French
110	119		Legation.
111	120		SECTION 8. On September 1, 2017, the following are
112	121		transferred to the Texas Historical Commission:
113	122		(1) all powers and duties of the Texas Facilities
114	123		Commission relating to the property known as the French Legation
115	124		and its grounds;
116	125		(2) all files and other records of the Texas
117	126		Facilities Commission relating to the French Legation;
118	127		(3) all contracts of the Texas Facilities Commission
119	128		pertaining specifically to the French Legation and its grounds; and
120	129		(4) all funds appropriated to the Texas Facilities
121	130		Commission designated for the benefit of the French Legation.
122	131		SECTION 9. On September 1, 2017, the Daughters of the
123	132		Republic of Texas shall transfer any money held in trust by the
124	133		organization under Section 2203.003, Government Code, as amended by
125	134		this Act, in relation to the property known as the French Legation
126	135		to the Texas Historical Commission to be held in trust by the
127	136		commission for the purposes described by Section 442.076,
128	137		Government Code, as redesignated and amended by this Act.
129	138		SECTION 10. This Act takes effect September 1, 2017.
