66 AN ACT
77 relating to rules and policies of the Texas Education Agency
88 regarding public involvement, complaints, negotiated rulemaking,
99 alternative dispute resolution, and advisory committees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 7, Education Code, is
1212 amended by adding Sections 7.034, 7.035, and 7.036 to read as
1313 follows:
1414 Sec. 7.034. PUBLIC INVOLVEMENT POLICY. The agency shall
1515 develop and implement a policy regarding public involvement with
1616 the agency. The policy must:
1717 (1) describe how the agency will proactively engage
1818 stakeholders;
1919 (2) distinguish the purposes and appropriate uses of
2020 advisory committees and informal work groups, including by
2121 specifying that an informal work group:
2222 (A) is not subject to Chapter 2110, Government
2323 Code; and
2424 (B) must have a well-defined purpose and follow
2525 specific timelines for completing tasks;
2626 (3) identify actions the agency will take that exceed
2727 the minimum open meetings requirements under Chapter 551,
2828 Government Code;
2929 (4) include a strategy for providing updated
3030 information regarding advisory committees and issues of concern to
3131 stakeholders through the agency's Internet website;
3232 (5) include an action plan for broadcasting and
3333 archiving video and audio of open meetings on the Internet; and
3434 (6) describe how public input will affect agency
3535 decisions, including by providing information regarding the
3636 specific outcomes for all types of public input.
3737 Sec. 7.035. COMPLAINTS. (a) The agency shall maintain a
3838 system to promptly and efficiently act on complaints filed with the
3939 agency. The agency shall maintain information about parties to the
4040 complaint, the subject matter of the complaint, a summary of the
4141 results of the review or investigation of the complaint, and its
4242 disposition.
4343 (b) The agency shall make information available describing
4444 its procedures for complaint investigation and resolution.
4545 (c) The agency shall periodically notify the complaint
4646 parties of the status of the complaint until final disposition.
4747 Sec. 7.036. NEGOTIATED RULEMAKING; ALTERNATIVE DISPUTE
4848 RESOLUTION. (a) The agency shall develop a policy to encourage the
4949 use of:
5050 (1) negotiated rulemaking procedures under Chapter
5151 2008, Government Code, for the adoption of agency rules; and
5252 (2) appropriate alternative dispute resolution
5353 procedures under Chapter 2009, Government Code, to assist in the
5454 resolution of internal and external disputes under the agency's
5555 jurisdiction.
5656 (b) The agency's procedures relating to alternative dispute
5757 resolution must conform, to the extent possible, to any model
5858 guidelines issued by the State Office of Administrative Hearings
5959 for the use of alternative dispute resolution by state agencies.
6060 (c) The agency shall:
6161 (1) coordinate the implementation of the policy
6262 adopted under Subsection (a);
6363 (2) provide training as needed to implement the
6464 procedures for negotiated rulemaking or alternative dispute
6565 resolution; and
6666 (3) collect data concerning the effectiveness of those
6767 procedures.
6868 SECTION 2. Subchapter C, Chapter 7, Education Code, is
6969 amended by adding Section 7.067 to read as follows:
7070 Sec. 7.067. ADVISORY COMMITTEE RULES. (a) The
7171 commissioner shall adopt rules, in compliance with Chapter 2110,
7272 Government Code, regarding an advisory committee that primarily
7373 functions to advise the commissioner or the agency, including rules
7474 governing an advisory committee's purpose, tasks, reporting
7575 requirements, and abolishment date.
7676 (b) The commissioner may adopt rules under this section
7777 regarding an advisory committee's:
7878 (1) size and quorum requirements;
7979 (2) qualifications for membership, including
8080 experience requirements and geographic representation;
8181 (3) appointment procedures;
8282 (4) terms of service; and
8383 (5) compliance with the requirements for open meetings
8484 under Chapter 551, Government Code.
8585 SECTION 3. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2017.
