77 relating to voting rights and eligibility for office of residents
88 of certain districts subject to a strategic partnership agreement.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.0751, Local Government Code, is
1111 amended by adding Subsection (q-1) to read as follows:
1212 (q-1) Except as provided by this subsection, the qualified
1313 voters of a district any part of which is annexed for limited
1414 purposes under a strategic partnership under this section are
1515 entitled to vote in municipal elections as provided by Section
1616 43.130. If the district includes area located in more than one
1717 municipality, a qualified voter of a district is not entitled to
1818 vote in municipal elections under this subsection if the voter is a
1919 resident of a municipality other than the municipality subject to
2020 the strategic partnership agreement. A resident of a district any
2121 part of which is annexed for limited purposes under this section is
2222 not eligible to be a candidate for or to be elected to a municipal
2323 office.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2017.
