88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. S
1010 ubchapter A, Chapter 372, Transportation Code,
1111 is amended by adding Section 372.002 to read as follows:
1212 Sec. 372.002. CONSIDERATION OF STAND-ALONE FINANCING
1313 REQUIRED. (a) A toll project entity having rulemaking authority by
1414 rule and a toll project entity without rulemaking authority by
1515 official action of its governing body shall adopt procedures to
1616 require that, for each toll project proposed by the toll project
1717 entity, including a tolled managed lane project, the toll project
1818 entity shall perform an analysis of the feasibility of financing
1919 the project as a stand-alone project before the toll project entity
2020 may create a system composed of the toll project or add the toll
2121 project to an existing system.
2222 (b) The procedures shall require the toll project entity to
2323 coordinate with local elected officials representing political
2424 subdivisions in which the proposed toll project is located when
2525 deciding whether the project should be financed as a stand-alone
2626 project or as part of a system, including providing a copy of the
2727 analysis to those local elected officials.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
