| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife |
|---|
| 10 | 10 | | Code, is amended by adding Section 43.370 to read as follows: |
|---|
| 11 | 11 | | Sec. 43.370. BREEDER DEER AFFECTED BY CHRONIC WASTING |
|---|
| 12 | 12 | | DISEASE. (a) Subchapter X does not apply to a breeder deer |
|---|
| 13 | 13 | | destroyed under this section. |
|---|
| 14 | 14 | | (b) The department shall make a payment to a deer breeder in |
|---|
| 15 | 15 | | an amount not to exceed $3,000 for the care of each breeder deer |
|---|
| 16 | 16 | | that is: |
|---|
| 17 | 17 | | (1) under the control of the deer breeder; and |
|---|
| 18 | 18 | | (2) destroyed after the department determines that the |
|---|
| 19 | 19 | | breeder deer is positive for chronic wasting disease under a herd |
|---|
| 20 | 20 | | certification program administered by the federal Animal and Plant |
|---|
| 21 | 21 | | Health Inspection Service. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies to the |
|---|
| 23 | 23 | | determination that a deer is affected by chronic wasting disease |
|---|
| 24 | 24 | | that occurs on or after the effective date of this Act. A |
|---|
| 25 | 25 | | determination that occurs before the effective date of this Act is |
|---|
| 26 | 26 | | governed by the law in effect at the time the deer was determined to |
|---|
| 27 | 27 | | be affected by chronic wasting disease, and that law is continued in |
|---|
| 28 | 28 | | effect for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2017. |
