66 AN ACT
77 relating to breeder deer affected by chronic wasting disease.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife
1010 Code, is amended by adding Section 43.370 to read as follows:
1111 Sec. 43.370. BREEDER DEER AFFECTED BY CHRONIC WASTING
1212 DISEASE. (a) Subchapter X does not apply to a breeder deer
1313 destroyed under this section.
1414 (b) The department shall make a payment to a deer breeder in
1515 an amount not to exceed $3,000 for the care of each breeder deer
1616 that is:
1717 (1) under the control of the deer breeder; and
1818 (2) destroyed after the department determines that the
1919 breeder deer is positive for chronic wasting disease under a herd
2020 certification program administered by the federal Animal and Plant
2121 Health Inspection Service.
2222 SECTION 2. The change in law made by this Act applies to the
2323 determination that a deer is affected by chronic wasting disease
2424 that occurs on or after the effective date of this Act. A
2525 determination that occurs before the effective date of this Act is
2626 governed by the law in effect at the time the deer was determined to
2727 be affected by chronic wasting disease, and that law is continued in
2828 effect for that purpose.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2017.
