66 AN ACT
77 relating to the payment for breeder deer taken for disease
88 management.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.955, Parks and Wildlife Code, is
1111 amended to read as follows:
1212 Sec. 43.955. COST RECOVERY. (a) The applicable permit
1313 holder shall pay all costs associated with[:
1414 [(1)] an epidemiological assessment conducted under
1515 this subchapter to the animal health commission[; and
1616 [(2) the destruction of deer under this subchapter to
1717 the department].
1818 (b) A permit holder under Subchapter R or R-1 shall pay all
1919 costs associated with the destruction of deer under this subchapter
2020 to the department.
2121 (c) The department shall pay the cost of a breeder deer
2222 destroyed under this subchapter to the holder of the permit under
2323 Subchapter L who held the breeder deer in captivity for the purpose
2424 of propagation. The amount paid under this section is $3,000 per
2525 deer or an amount set by the commission, whichever is higher.
2626 SECTION 2. The change in law made by this Act applies to the
2727 destruction of a deer on or after the effective date of this Act.
2828 The destruction of a deer before the effective date of this Act is
2929 governed by the law in effect at the time the deer was destroyed and
3030 that law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2017.
