| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 43.955, Parks and Wildlife Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 43.955. COST RECOVERY. (a) The applicable permit |
|---|
| 13 | 13 | | holder shall pay all costs associated with[: |
|---|
| 14 | 14 | | [(1)] an epidemiological assessment conducted under |
|---|
| 15 | 15 | | this subchapter to the animal health commission[; and |
|---|
| 16 | 16 | | [(2) the destruction of deer under this subchapter to |
|---|
| 17 | 17 | | the department]. |
|---|
| 18 | 18 | | (b) A permit holder under Subchapter R or R-1 shall pay all |
|---|
| 19 | 19 | | costs associated with the destruction of deer under this subchapter |
|---|
| 20 | 20 | | to the department. |
|---|
| 21 | 21 | | (c) The department shall pay the cost of a breeder deer |
|---|
| 22 | 22 | | destroyed under this subchapter to the holder of the permit under |
|---|
| 23 | 23 | | Subchapter L who held the breeder deer in captivity for the purpose |
|---|
| 24 | 24 | | of propagation. The amount paid under this section is $3,000 per |
|---|
| 25 | 25 | | deer or an amount set by the commission, whichever is higher. |
|---|
| 26 | 26 | | SECTION 2. The change in law made by this Act applies to the |
|---|
| 27 | 27 | | destruction of a deer on or after the effective date of this Act. |
|---|
| 28 | 28 | | The destruction of a deer before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law in effect at the time the deer was destroyed and |
|---|
| 30 | 30 | | that law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2017. |
